Stunt performer Devyn LaBella sued Kevin Costner and three production companies in May 2025, alleging she was directed into an unscripted sexual-violence scene while working on Horizon: An American Saga – Chapter 2 without advance notice or consent. What LaBella says happened on the Horizon set
LaBella, who worked as a stunt performer and doubled for actor Ella Hunt, filed her lawsuit on May 27, 2025, in Los Angeles County Superior Court. The named defendants are Costner, Horizon Series Inc., Horizon Series 2 LLC, and Territory Pictures Inc. The Associated Press reported on the filing and the parties’ positions; the Los Angeles Times also covered the complaint.

According to her complaint, an incident occurred during filming on May 2, 2023. LaBella alleges that she was asked to perform in a sexual-violence sequence that had not been scripted or scheduled, and that she had not received advance notice or the consent and safety procedures she says were required. She further alleges sexual discrimination and harassment, a hostile work environment, retaliation, and related violations.
Those are allegations, not findings by a court. Costner’s attorney, Martin Singer, denied them, saying the claims lacked merit and conflicted with the facts and LaBella’s conduct. The defense has cited a text message, but its existence alone does not resolve the disputed account. The AP and Los Angeles Times reports describe the opposing positions; neither a motion ruling nor the current scheduling information establishes that either side’s account has been proven.

What the judge decided in October 2025
On October 16, 2025, Los Angeles Superior Court Judge Jon R. Takasugi denied the defense request to strike the entire complaint under California’s anti-SLAPP law. The court nevertheless dismissed one sexual-harassment claim and one claim alleging civil-rights violations. MyNewsLA reported the October ruling.
An anti-SLAPP motion is a procedural challenge under California law; this ruling was not a trial on whether the alleged events occurred, and it did not determine liability. The result was mixed: the complaint was not eliminated in full, while two claims were dismissed.

Both sides appealed. On November 21, 2025, a joint stipulation to pause trial-court proceedings while the appeals proceeded was granted. MyNewsLA reported that the proceedings were put on hold.
A Trellis docket-aggregator page, last refreshed September 18, 2026, lists a status conference for October 28, 2026. That date is a scheduled event, not a report that the conference has taken place. The available sources do not establish a final judgment on the claims or an appellate disposition. The Trellis listing identifies the Los Angeles County case and its docket status; it is an aggregator rather than the court itself.
