Prosecutors later charged him with two misdemeanors; June reports described a conditional diversion program, but do not establish whether the charges were ultimately dismissed.
What the arrest footage showed
Osment was arrested on April 8, 2025, at Mammoth Mountain in Mammoth Lakes, California. Footage from an officer’s body camera showed him using hostile language, including an antisemitic slur directed at the officer. The video became public in April, prompting Osment to issue an apology. The Independent’s April 19 report said Osment shared his statement with People magazine.
What Osment said in his apology
Osment said he was “absolutely horrified” by his behavior and that he had not known he used the language while in what he described as a blackout. He apologized to those hurt, said he had let the Jewish community down, and promised to atone. He also referred to recent loss and displacement as factors that had left him in a low emotional state, while explicitly saying they were no excuse for using the slur. TheWrap’s April 18 report also covered the apology.
What charges were filed
In a release dated April 17, 2025, the Mono County District Attorney’s Office said Osment faced two misdemeanor charges:

- Disorderly conduct under the influence of alcohol in public, under California Penal Code § 647(f).
- Possession of cocaine, under California Health and Safety Code § 11350(a).
The charging announcement is an allegation, not a finding of guilt. The District Attorney’s Office stated that the charges must be proven beyond a reasonable doubt and that defendants are presumed innocent unless proven guilty. The office’s April 17 charging release identifies the offenses. The arrest footage does not by itself establish that Osment possessed cocaine.

News reports published June 2–4, 2025, said a judge granted Osment a one-year diversion program involving Alcoholics Anonymous meetings and therapy. Those reports described dismissal of the charges as conditional on completing the program’s terms, not as an immediate outcome. The San Francisco Chronicle’s June 4 report described the program and conditional dismissal.
The available reporting does not establish whether Osment completed diversion or whether the charges were later dismissed. The final disposition therefore should not be stated as confirmed.
