Former Cake Drummer Peter McNeal Sentenced to 15 Years to Life

Peter Ivan McNeal, formerly a drummer for Cake, received a 15-years-to-life sentence in 2014 following a jury conviction in a child molestation case.

Former Cake drummer Peter Ivan McNeal was sentenced on December 2, 2014, to 15 years to life in California state prison after a jury convicted him of one count of oral copulation of a child age 10 or younger. Los Angeles County Superior Court Judge Fred Wapner also ordered him to register as a sex offender for life.

What was McNeal convicted of?

A jury found McNeal guilty in March 2013 of one count of oral copulation of a child age 10 or younger. The Los Angeles County District Attorney’s Office said the Los Angeles Police Department investigated the case. The DA’s sentencing announcement attributed this account to Deputy District Attorney Elena Abramson: “McNeal molested the girl on Thanksgiving 2009 at a Laurel Canyon home where he was a guest.”

The appellate opinion reproduced in a Supreme Court docket filing identifies the conviction as a violation of California Penal Code section 288.7(b). It also says the 2013 conviction followed a second trial; the first jury was unable to reach a unanimous verdict. The opinion identifies itself as unpublished, so it should not be described as published precedent. The docket filing containing the opinion provides that procedural account.

What sentence did the court impose?

On December 2, 2014, Judge Fred Wapner sentenced McNeal, then 48, to 15 years to life in California state prison and ordered him to register as a sex offender for life, according to the Los Angeles County District Attorney’s Office. The Sacramento Bee independently reported the sentence and lifetime registration requirement the following day.

What is known about his status now?

The reported court and news accounts establish the historical conviction and sentence. They do not establish McNeal’s custody or parole status as of October 8, 2026; the sentence alone is not enough to determine whether he is currently incarcerated or has been released.
