Por que Fiona Harvey processou a Netflix?
Harvey ajuizou a ação em 6 de junho de 2024 no Tribunal Distrital dos Estados Unidos para o Distrito Central da Califórnia. As rés nomeadas foram Netflix, Inc. e Netflix Worldwide Entertainment, LLC; Richard Gadd não foi réu nessa ação. A denúncia apresentou seis causas de ação sob a lei da Califórnia: difamação, imposição intencional de sofrimento emocional, negligência, negligência grave e duas teorias de violação do direito de publicidade.
Segundo a denúncia, a série abre com a frase “This is a true story” e retrata Martha como uma perseguidora condenada duas vezes, sentenciada a cinco anos de prisão e autora de agressão sexual contra o personagem de Gadd. Harvey alegou que essas representações eram falsas e que pistas na série — inclusive uma publicação antiga em rede social — permitiam identificá-la. São afirmações da autora, não fatos estabelecidos por uma decisão final. A petição também chamou o caso de “the biggest lie in television history”; essa é retórica da parte autora, não uma conclusão neutra ou judicial.

A Netflix contestou a ação e argumentou que a série é expressão criativa protegida e que espectadores razoáveis não entenderiam suas representações como afirmações factuais sobre Harvey. Assim, a disputa envolve tanto as alegações sobre falsidade e identificação quanto a interpretação da obra e a proteção de sua expressão.

O que o juiz decidiu em setembro de 2024?
Em 27 de setembro de 2024, o tribunal decidiu parcialmente a moção anti-SLAPP da Netflix: rejeitou as alegações de negligência e de violação do direito de publicidade, além da demanda por danos punitivos, mas permitiu que as reivindicações de difamação e imposição intencional de sofrimento emocional prosseguissem naquela etapa.
Essa decisão não concluiu que Harvey provou suas acusações. Ao avaliar a moção, o tribunal considerou as alegações da denúncia como verdadeiras e as interpretou favoravelmente à parte que não apresentou a moção, conforme a regra processual aplicável àquela análise preliminar. A sobrevivência de duas reivindicações nesse estágio não equivale a uma decisão de responsabilidade após julgamento.

A Netflix recorreu ao Nono Circuito em outubro de 2024, e o processo em primeira instância foi suspenso enquanto a apelação estivesse pendente. A listagem consultada para a apelação 24-6151 foi recuperada pela última vez em outubro de 2024 e registra prazos iniciais de 2024–2025; ela não estabelece o que ocorreu depois. Por isso, não é possível afirmar com base nas fontes disponíveis se houve decisão final, acordo ou retomada do processo distrital.
