Disney did not ask a court to rule that it was free of liability in the wrongful-death lawsuit over Kanokporn Tangsuan’s death. In 2024, it asked a Florida court to send the dispute to arbitration, citing terms Jeffrey Piccolo had accepted through a Disney+ account and a Disney park-ticket purchase. After Piccolo’s lawyers challenged that argument, Disney withdrew its arbitration demand and agreed to let the case proceed in court. The withdrawal was not a ruling on the lawsuit’s merits.
What happened in the lawsuit
Kanokporn Tangsuan died after suffering an allergic reaction following a meal at Raglan Road in Disney Springs, according to reporting on the lawsuit. The complaint alleged that Tangsuan had dairy and nut allergies, that she and Piccolo asked restaurant staff about allergens, and that staff assured them the food was safe. Those are allegations described in the lawsuit, not findings established by a court in the reporting.
Jeffrey Piccolo brought a wrongful-death action against Disney and the restaurant. The procedural dispute that drew attention was over where the case should be heard—not whether the allegations were true or whether Disney was liable.
Why Disney cited a Disney+ agreement
Disney argued that Piccolo had agreed to arbitrate certain disputes involving Disney or its affiliates when he created a Disney+ account in 2019. It also relied on terms associated with his 2023 purchase of a Disney park ticket. In May 2024, Disney asked the court to compel arbitration and pause the court case, according to the Los Angeles Times.

Arbitration is a private process for resolving a dispute outside the ordinary court trial process. A request to compel arbitration concerns the forum for a case; it is not, by itself, a decision that the defendant has no liability.
Why Piccolo’s lawyers objected
Piccolo’s attorneys argued that the Disney+ terms did not apply to a restaurant-related wrongful-death claim and that Tangsuan’s estate could not be bound by an agreement Piccolo had accepted. The dispute therefore raised two separate questions: whether the terms covered this kind of claim, and whether they could apply to a claim brought on behalf of someone who had not accepted them.

Those were the parties’ competing legal positions. The available reporting does not establish that a judge ruled the agreement enforceable for this claim or decided whether the estate could be bound.

In August 2024, after Piccolo’s lawyers opposed the motion, Disney waived its arbitration demand and said the case could proceed in court. The Guardian and the Los Angeles Times reported the reversal. Disney’s withdrawal meant the reported request to move the dispute into arbitration was no longer being pursued; it did not decide the underlying wrongful-death claims.

What the reporting does—and does not—establish
