The dispute followed an alleged fatal food-allergy incident at Raglan Road Irish Pub and Restaurant in Disney Springs. Disney’s decision changed the proposed forum; it did not admit fault or decide whether either defendant was liable.
What happened at Raglan Road
The lawsuit concerns dinner on October 5, 2023, at Raglan Road Irish Pub and Restaurant in Disney Springs. According to the complaint, Kanokporn Tangsuan had severe dairy and nut allergies, and she and her party asked for food that was free of those allergens. The complaint alleges that Tangsuan later died from anaphylaxis. The allegations and reported medical-examiner findings are part of the case record, not a court finding of liability.
Jeffrey Piccolo filed the case as personal representative of Tangsuan’s estate. The defendants are Great Irish Pubs Florida, which operates Raglan Road, and Walt Disney Parks and Resorts U.S., Inc. The Associated Press reported that the complaint sought damages exceeding $50,000; that is a claimed amount, not an award. The case was filed in Orange County, Florida, under case number 2024-CA-001616-O. The Associated Press reported on the filing and allegations.
Why Disney sought arbitration
On May 31, 2024, Walt Disney Parks and Resorts U.S. filed a motion asking the court to compel arbitration and pause the lawsuit. Disney argued that Piccolo had accepted arbitration terms through a Disney+ trial and a later park-ticket purchase. The motion did not ask the court to decide the underlying negligence allegations; it sought to move the dispute out of court and into arbitration. The motion to compel arbitration is Disney’s filing and states its position, not a judicial ruling.

The plaintiff opposed the motion. Piccolo’s August 2 filing argued that the Disney agreements should not govern the estate’s wrongful-death claims, which arose from a restaurant meal rather than use of Disney+. The case docket listing identifies the opposition filing and case number. The competing arguments raised whether online terms accepted for one service could apply to claims about a separate event; the court did not resolve that question before Disney withdrew its request.
Disney’s relationship to the restaurant
The motion characterized Great Irish Pubs Florida as the restaurant’s independent owner and operator and Disney as the property’s lessor. The complaint, by contrast, alleged an agency relationship and cited Disney’s descriptions of allergy accommodations as part of its asserted basis for Disney responsibility. Those are the parties’ respective positions, not findings establishing who was legally responsible. It would be inaccurate to describe Disney as the restaurant’s owner or operator based on the filings summarized here.

Disney withdrew the arbitration request
On August 19, 2024, Disney Experiences chairman Josh D’Amaro announced that Disney would waive arbitration and allow the lawsuit to proceed in court. He said: “At Disney, we strive to put humanity above all other considerations. With such unique circumstances as the ones in this case, we believe this situation warrants a sensitive approach to expedite a resolution for the family who have experienced such a painful loss.” The announcement was reported by the Associated Press.
Waiving arbitration was a litigation decision about where the case would proceed. It was not an admission of negligence, a settlement, or a decision on damages. The underlying claims still required resolution through the legal process.
