Disney initially argued that arbitration terms tied to Jeffrey Piccolo’s Disney+ account could require him to take a wrongful-death lawsuit over a restaurant meal out of court. Piccolo’s lawyer called that position “outrageously unreasonable.” Disney later waived its arbitration rights, and Piccolo voluntarily dismissed the case in February 2026. No court ruled on whether the Disney+ terms applied, and public reporting does not confirm any settlement terms or payment.
What the lawsuit alleged
On October 5, 2023, Kanokporn Tangsuan and her family ate at Raglan Road Irish Pub and Restaurant at Disney Springs in Orlando. Tangsuan had severe dairy and nut allergies. Her husband, Jeffrey Piccolo, later sued Walt Disney Parks and Resorts and restaurant-related entities, alleging that staff assured the family the dishes could be prepared without the allergens. Tangsuan suffered a fatal allergic reaction later that evening.
The account of staff assurances and the food served came from the complaint; they were allegations, not findings reached after a trial. The complaint sought more than $50,000 in damages, according to the Associated Press’s 2024 report. That was the amount sought in the lawsuit, not a confirmed award or settlement.
Why Disney+ terms became part of a restaurant case
In a May 2024 court filing, Disney argued that Piccolo had agreed to arbitration through terms associated with his Disney+ account and his use of Disney services. Disney asked the court to compel arbitration and pause the lawsuit. It also emphasized that Raglan Road was independently operated. The dispute raised whether those agreements could extend to a separate wrongful-death claim involving a restaurant; the court did not decide that question.

Piccolo’s lawyer, Brian Denney, challenged the reach and fairness of applying a Disney+ free-trial agreement to the case. In the plaintiff’s filing, he argued: “The notion that terms agreed to by a consumer when creating a Disney+ free trial account would forever bar that consumer’s right to a jury trial in any dispute with any Disney affiliate or subsidiary, is so outrageously unreasonable and unfair as to shock the judicial conscience, and this court should not enforce such an agreement.” This was the plaintiff’s legal argument, not a judge’s conclusion.
Disney withdrew its arbitration position
After the argument drew widespread criticism, Disney said in August 2024 that it would waive its arbitration rights and allow the lawsuit to proceed in court. That was a change in Disney’s legal position, not a court ruling that the arbitration clause was invalid or inapplicable.

News reporting says Piccolo voluntarily dismissed the lawsuit on February 27, 2026. Bloomberg Law described the dismissal as with prejudice. News 12 reported that it was not immediately clear whether the parties had reached a financial settlement. The available reporting does not confirm that a settlement was paid or disclose any terms.
