What did Dawn Richard accuse Sean Combs of?
Richard’s September 10, 2024, complaint in the U.S. District Court for the Southern District of New York described her work with Combs beginning with her 2004 audition for Making the Band, her membership in Danity Kane, and later work with Diddy–Dirty Money. The court’s opinion describes their association as running from 2004 to 2012.
According to the complaint, Combs subjected Richard and others to sexual harassment, physical violence, threats, and exploitative working conditions. It also alleged sexual assault and battery, sex trafficking, gender discrimination, fraud, and related misconduct, and said Richard witnessed abuse of Cassie Ventura. These were allegations in a civil lawsuit, not findings established at trial. Read the initial complaint filed September 10, 2024.
Did the judge dismiss Richard’s lawsuit?
Yes. In June 2026, U.S. District Judge Katherine Polk Failla granted the defendants’ motion to dismiss the operative Second Amended Complaint, which contained 18 counts. The order dismissed Count One without prejudice and Counts Two through Eighteen with prejudice, and directed the clerk to close the federal case. The court’s opinion and order explains that Counts Two through Sixteen were time-barred and separately dismisses the copyright claims.

What “without prejudice” and “with prejudice” mean here
Count One’s dismissal without prejudice means it could be brought again in state court; it does not mean a new case was filed. Dismissal with prejudice generally bars bringing those dismissed claims again. The court’s order—not a jury verdict—determined the federal case’s procedural outcome.
Did the dismissal mean the allegations were false?
No. The ruling did not decide whether the alleged conduct occurred. The judge said the court treated well-pleaded allegations as true only for purposes of deciding the motion to dismiss; that is a legal assumption at that stage, not a factual finding after trial. She also wrote: “The Court’s resolution of the instant motion exists independently of its disapprobation of the factual allegations, which, if true, are execrable,” and, “The Court is, of course, compelled to follow the law.”

What did Combs and Richard’s lawyer say?
Reuters reported that Combs representative Erica Wolff said he was “shocked and disappointed” by the lawsuit and described its claims as false. After the dismissal, the Associated Press reported that Richard’s lawyer, Arick Fudali, said she intended to continue pursuing her primary claim. Those are statements by the parties’ representatives, not court findings.

Richard’s lawyer told the Associated Press that she intended to refile the primary claim in state court under the gender-motivated violence act. The reporting establishes that announced intention, but does not establish that a state-court complaint was subsequently filed. The federal order left Count One dismissed without prejudice, which permits a renewed claim in state court; whether a filing followed is a separate question.
