Dawn Richard’s Federal Civil Lawsuit Against Sean “Diddy” Combs Dismissed

A federal judge dismissed Dawn Richard’s civil case against Sean “Diddy” Combs. One count may be refiled in state court; the other 17 were dismissed with prejudice.

A federal judge dismissed Dawn Richard’s civil lawsuit against Sean “Diddy” Combs, but the ruling did not decide whether her allegations were true. In Richard v. Combs, the court dismissed one of 18 counts without prejudice and the other 17 with prejudice. Richard’s lawyer said she intended to refile her primary claim in state court; that was an announced plan, not a completed filing.

Which lawsuit was dismissed?

The headline refers to musician and performer Dawn Richard’s federal civil case, Richard v. Combs et al., No. 1:24-cv-06848—not to every civil lawsuit involving Combs. Judge Katherine Polk Failla of the U.S. District Court for the Southern District of New York issued the opinion on June 12, 2026; the docket lists June 15 as the decision date, and the Associated Press reported the ruling on June 15.

Richard sued Combs, his business associate Harve Pierre, Combs-related entities, and other named and unnamed defendants in 2024. The court described Richard’s work with Combs as beginning in 2004, first with Danity Kane and later with Diddy – Dirty Money, and ending around 2011 or 2012. Her second amended complaint asserted 18 claims, primarily tort claims based on alleged emotional abuse and manipulation, as well as copyright infringement claims. These are allegations in the complaint, not findings established by the dismissal ruling.

What did the judge order?

Judge Failla granted the defendants’ motion to dismiss. The court dismissed Count One without prejudice and Counts Two through Eighteen with prejudice, terminated pending motions, and directed the clerk to close the case.

Why was Richard’s lawsuit dismissed?

The court granted the defendants’ motion to dismiss the claims in Richard’s second amended complaint. The court’s opinion is the source for the disposition, but the available reporting does not establish a broader explanation that should be substituted for the judge’s legal analysis.

Failla emphasized that the legal ruling was separate from her view of the alleged conduct. The opinion states: “The Court’s resolution of the instant motion exists independently of its disapprobation of the factual allegations, which, if true, are execrable.” It adds: “The Court is, of course, compelled to follow the law.”

The opinion considered the complaint’s well-pleaded allegations as true for purposes of deciding the motion. That is a procedural convention, not a factual finding that the allegations were true; the dismissal likewise did not establish that they were false.

Can Dawn Richard refile her claim?

The court’s order allows Count One to be refiled in state court. The Associated Press reported that Richard’s lawyer, Arick Fudali, said she intended to refile her primary claim under New York City’s gender-motivated violence act. That statement describes counsel’s announced intention, not a filing already made.

Fudali also said, “We intend to continue to fight for Dawn until justice is achieved,” according to the AP.

Is this the same as Combs’s criminal case?

No. Richard’s lawsuit was a civil action, separate from Combs’s criminal prosecution. The AP reported that Richard testified in the criminal trial, where Combs was convicted on prostitution-related charges and acquitted of sex-trafficking charges. The dismissal of Richard’s civil case did not change or resolve that criminal case.
