George R. R. Martin is one of several authors suing OpenAI in an Authors Guild-led copyright case—not the plaintiff in a separate lawsuit over one fan-fiction prompt. The complaint alleges that ChatGPT generated summaries and detailed outlines based on Martin’s A Song of Ice and Fire books, including a prequel and an alternate sequel using existing characters. Those are the plaintiffs’ allegations, not findings that OpenAI infringed copyright.
Who is Martin suing?
Martin joined other authors as a named plaintiff in a class action led by the Authors Guild against OpenAI and related defendants. The consolidated complaint says Martin owns or beneficially owns registered copyrights in 15 works and alleges that OpenAI copied books without permission to train large language models. The case is broader than Martin’s books and involves multiple authors.
So “ChatGPT wrote Game of Thrones fanfic” is shorthand for examples in the complaint. The suit is against OpenAI entities, not ChatGPT as if it were a person or company, and the filing does not describe a standalone case brought only over an individual fan-fiction prompt. The Authors Guild’s September 2026 update describes the consolidated litigation as involving OpenAI and Microsoft.
What did ChatGPT allegedly generate?
The December 2023 consolidated complaint describes prompts that allegedly produced summaries of A Game of Thrones, A Clash of Kings and A Storm of Swords, as well as two story outlines using characters from the series:

- “A Dance With Shadows” — an alleged alternate sequel outline.
- “A Dawn of Direwolves” — an alleged prequel outline.
The complaint characterizes the prequel outline as unauthorized and infringing. That wording represents the plaintiffs’ position; it is not a court’s conclusion about the output, the training of the models, or whether copyright law was violated.
What does the Berkeley study have to do with it?
The complaint also cites a 2023 study by University of California, Berkeley researchers Kent K. Chang and co-authors, Speak, Memory: An Archaeology of Books Known to ChatGPT/GPT-4. As the complaint reports the study, A Game of Thrones ranked 12th on the study’s measure of “memorization.” That is a reported ranking for that measure—not a finding by the court that a particular book was memorized or infringed. Has a judge ruled that OpenAI infringed copyright?
No final finding of infringement is established by the rulings and updates described here. On October 27, 2025, the U.S. District Court for the Southern District of New York denied OpenAI’s motion to dismiss the consolidated complaint’s output-based infringement claim, finding that the complaint adequately stated a prima facie claim. That was a pleading-stage decision: it allowed the claim to proceed, rather than deciding whether infringement actually occurred.

In a September 2026 update, the Authors Guild said the class plaintiffs had filed for summary judgment on September 4 and that defendants had filed their own summary-judgment motions. The Guild also reported that fact and expert discovery had been completed that summer. A summary-judgment motion asks a court to decide legal issues without a trial; if material facts remain disputed, the case may proceed to trial. The sources cited in that update do not establish a decision on the motions, a trial date, a settlement or a final outcome.
