It can, if the particular use qualifies as fair use under the law that applies—but there is no guaranteed way to use clips in a 24/7 YouTube stream without a copyright claim, interruption or strike. YouTube scans livestreams for third-party matches, and a creator’s belief that a clip is fair use does not prevent that system or a rights holder from acting. Fair use is a case-by-case legal question, separate from YouTube’s enforcement process.
What fair use means for a 24/7 stream
In the United States, fair use is assessed under four factors in 17 U.S.C. § 107. No fixed clip length, percentage, disclaimer, or continuous-stream format guarantees that a use is fair. The U.S. Copyright Office explains that the factors are weighed together and that only a federal court can ultimately determine whether a specific use is fair.

For a continuous stream, assess the clips in context: their purpose, how much is shown over time, whether they are repeated, and whether the overall stream substitutes for the originals. A stream that adds meaningful criticism is not automatically fair, just as a 24/7 format is not automatically unfair. The official sources do not establish a special safe harbor for continuous streams.
These are U.S. fair-use principles. Other countries and regions may apply different rules, including fair dealing or other copyright exceptions. Do not assume that a U.S. fair-use analysis settles the question everywhere.

What YouTube can do while the stream is live
YouTube says it scans all livestreams for matches to third-party content, including material from another live broadcast. If it identifies a match, it may replace the stream with a placeholder image and warn the creator to stop using the content. If the material remains, YouTube may temporarily interrupt or terminate the livestream.
A licence does not necessarily prevent that interruption. YouTube advises creators with permission to use third-party material to ask the rights owner to add their channel to the owner’s Content ID allowlist. A stream can still be interrupted if the channel is not allowlisted, even when the creator is licensed or has geographically restricted the broadcast. Allowlisting addresses live matching; it does not decide whether a use is fair.

If the creator archives the stream, YouTube says Content ID claims are made after the livestream finishes. That later claim is separate from what may happen during the live broadcast.
A claim, a takedown and a strike are different
A Content ID claim typically does not itself result in a copyright strike. A copyright removal request is a separate legal request; if YouTube finds it valid, it removes the content and issues a strike. YouTube also says that when an active livestream is removed for copyright, the channel receives a strike and loses livestream access for seven days. A subsequent strike can extend the livestream restriction to fourteen days.

When a removal request is scheduled, YouTube says the uploader has seven days to take certain actions, such as deleting the content or seeking a retraction, to avoid removal and a strike. YouTube describes counter notification as an option if the uploader believes removal was mistaken or the use qualifies for an exception such as fair use. A counter notification is a legal process—not a platform ruling that the use was fair. YouTube does not decide ownership disputes, and the parties may need to resolve them in court.
On its official removal-request guidance, YouTube reports that it received requests concerning over 16 million videos in 2022. That historical platform-reported figure is about removal requests for videos; it does not count livestreams, strikes, or fair-use decisions.

Review clips before putting them in an always-on broadcast
- Identify the jurisdiction. Determine which country’s copyright rules may apply to the use and audience. The four-factor discussion above describes U.S. law, not a universal rule.
- Write down the purpose of each clip. State what your own commentary, criticism, teaching, or reporting adds. If the clip is mainly there to entertain or replay the source, do not treat its inclusion as automatically transformative.
- Assess the source and the excerpt. Consider whether the original is factual or highly creative, how much you use, and whether the excerpt contains a particularly important part.
- Consider the market and the full schedule. Ask whether viewers could substitute the stream for the original or a licensed viewing. Account for cumulative use and repetition across the 24/7 broadcast, not only one isolated excerpt.
- Check rights and operational status. If you have a licence, read its terms and ask the rights owner whether your channel must be added to its Content ID allowlist before you go live. Permission and allowlisting are distinct from a fair-use conclusion.
- Decide whether the uncertainty is acceptable. No checklist can guarantee a result. For a high-stakes or uncertain use, YouTube suggests seeking legal advice.
Giving credit, adding a disclaimer, not monetizing, or keeping a clip below a particular number of seconds is not an automatic safe harbor in the official guidance. Nor does making the stream live or continuous settle the legal question.
