Balloon Boy Hoax: Heene Family Says the “Whole Story” Wasn’t Told

In 2025, the Heene family said the public story of the 2009 Balloon Boy incident was incomplete. Here’s what the family claims—and what the legal record establishes.

The Heene family still says the 2009 “Balloon Boy” incident was not what the public was led to believe. In a 2025 interview with PEOPLE, Richard Heene said the family pleaded guilty under duress and that “The whole story … was not told correctly.” Those are the family’s claims—not a new court finding. The documented history includes guilty pleas, jail sentences and 2020 pardons; the available reporting does not establish that the pardons overturned the pleas or proved factual innocence.

What happened during the Balloon Boy incident?

On October 15, 2009, a homemade saucer-shaped balloon left the Heene family’s property in Colorado. The family reported that six-year-old Falcon might be aboard, prompting a public search and intense media attention. Falcon was later found in the home’s garage attic, according to PEOPLE’s 2025 retrospective.

Suspicion grew after Falcon appeared on CNN. CBS quoted him as saying, “You guys said, that, um, we did this for the show.” That wording comes from CBS’s contemporaneous report; accounts of the remark have varied, so it is best understood as a reported quotation rather than a definitive transcript of every version of what he said.

How did investigators’ view change?

On October 16, Larimer County Sheriff Jim Alderden said investigators did not yet regard the incident as a hoax. “We believe at this time it’s a real event. People are free to speculate, be skeptical about it,” he said, adding that investigators would continue working to establish the facts. He also cited Falcon’s remark as a reason to re-interview the family. CBS reported that statement at the time: “Balloon Boy Drama Was ‘Real Event,’ Says Sheriff”.

The sheriff later announced that authorities believed the incident had been a publicity stunt. The shift matters: the initial public statement was not a settled conclusion that the event was genuine, nor had investigators announced a hoax finding at that point.

What did Richard and Mayumi Heene plead guilty to?

In November 2009, Richard Heene pleaded guilty to falsely influencing a public servant, and Mayumi Heene pleaded guilty to false reporting. Richard was sentenced to 90 days in jail; Mayumi received 20 days. CBS News and the Associated Press reported that the pleas were part of an agreement: “Balloon Boy Parents Plead Guilty”.

Richard’s attorney, David Lane, said the agreement was intended to avoid possible deportation consequences for Mayumi, a Japanese citizen, if she faced more serious charges. That is the attorney’s explanation of the agreement, not an independently established account of the couple’s motives.

What is the family saying now?

In a report updated July 15, 2025, PEOPLE described the family’s renewed claim of innocence and its account that the guilty pleas came under duress to end the controversy. Richard said the family was misunderstood and that media coverage skewed the narrative. He summarized his view: “The whole story … was not told correctly.” These are retrospective statements by the family; the reporting does not independently verify them.

Falcon, then 22, told PEOPLE that the event “got way out of hand.” He said his recollection was foggy and that much of what he remembered came from videos he had watched. He also reflected, “It’s one of those things that people look back at and are like, ‘That’s crazy!’” Those comments describe Falcon’s recollection and perspective as reported in the interview, not a separate finding about what happened.

Were the Heenes pardoned—and what did that change?

Colorado Gov. Jared Polis pardoned Richard and Mayumi Heene in 2020. The Associated Press reported the pardons on December 23: “Parents convicted in 2009 ‘balloon boy’ hoax pardoned”.

A pardon is distinct from the earlier guilty pleas and sentences. The reporting establishes that the pardons occurred; it does not establish that they vacated the pleas or amounted to a judicial finding that the family’s account of innocence was true. The family’s position after the pardons and the legal record should therefore be kept separate.

Where is the Heene family now?

In the 2025 PEOPLE interview, the family was living in rural central Florida and building tiny homes on its property. The report also says Richard and Mayumi have maintained their innocence after the pardons and that the family appears in Netflix’s documentary Trainwreck: Balloon Boy. These are details from the interview and may change.

How to understand the competing accounts

The public record and the family’s later explanation answer different questions. The contemporaneous reporting documents what officials said as the investigation developed, and the 2009 reports document the guilty pleas and sentences. The 2020 coverage establishes that the couple received pardons. The 2025 interview records the family’s account of why it pleaded guilty and why it continues to deny the public narrative. The sources cited here do not resolve that retrospective dispute with a new judicial determination.
