Austin Wolf, the professional name of Justin Heath Smith, was arrested in June 2024 after federal prosecutors filed child-pornography charges. The case later ended in a guilty plea and a 19-year prison sentence: the U.S. Attorney’s Office for the Southern District of New York announced the sentence on September 29, 2025.
What happened in the Austin Wolf case?
Federal authorities arrested Smith in June 2024. At that stage, the allegations appeared in a criminal complaint, and the U.S. Department of Justice explicitly described the charges as accusations. The later case outcome was different in procedural terms: Smith pleaded guilty, and a federal judge imposed a prison sentence in September 2025.

The two official announcements describe distinct stages of the case. The June 28, 2024 announcement reported the arrest and complaint charges; the September 29, 2025 announcement reported the guilty plea and sentence.
How did the case progress?
- April 21, 2024: The later sentencing announcement says the FBI executed a search warrant at Smith’s Manhattan apartment. The initial DOJ announcement reported that agents found an SD card containing hundreds of videos.
- June 28, 2024: DOJ announced Smith’s arrest and the complaint charges. The release said he would be presented in Manhattan federal court.
- June 20, 2025: The sentencing announcement identifies this as the date Smith pleaded guilty.
- September 29, 2025: DOJ announced the sentence imposed by Judge Paul A. Engelmayer.
What was he initially charged with?
The June 2024 complaint charged Smith with distribution and receipt of child pornography, as well as possession of child pornography. Those were allegations in the complaint—not a conviction at the time of his arrest. DOJ stated: “The charges contained in the Complaint are merely accusations, and the defendant is presumed innocent unless and until proven guilty.”

What was the outcome?
According to the Southern District of New York’s sentencing announcement, Smith pleaded guilty to offenses involving enticing a minor to engage in illegal sexual activity and engaging in a pattern of activity involving prohibited sexual conduct. Judge Paul A. Engelmayer sentenced him to 19 years in prison, followed by 10 years of supervised release, and imposed a $40,000 fine.
The DOJ announcement also says authorities found approximately 1,291 files containing child pornography in Smith’s possession and that he shared such material with at least 15 other individuals. These figures are statements in the sentencing announcement, not independent estimates.
