Was Jimmy Kimmel’s Suspension Government Censorship? What the Record Shows as of October 2026

The record supports calling the 2025 Jimmy Kimmel suspension government-pressured censorship in the ordinary sense, but no court has ruled it unconstitutional. Here is the timeline, the legal test, and the status as of October 8, 2026.

Partly yes, and the qualification matters. The record supports describing the September 2025 suspension of Jimmy Kimmel Live! as government-pressured censorship in the ordinary sense: the FCC chairman publicly raised regulatory consequences for broadcasters carrying the show, and ABC and major station groups pulled or preempted it within hours. What the record does not show is a court ruling that the suspension was unconstitutional government censorship. As of October 8, 2026, that legal question was still open.

What happened, in order

  1. September 15, 2025: Kimmel commented on reactions to the assassination of Charlie Kirk.
  2. September 17, 2025: FCC Chair Brendan Carr publicly warned broadcasters that there could be “additional work for the FCC ahead” if they did not act against Kimmel. A Senate inquiry, in a letter from the office of Senator Chris Van Hollen dated September 24, 2025, also attributes to Carr the phrase “We can do this the easy way or the hard way” and a reference to potential fines or license revocation. These are the senators’ account of the remarks, not findings by a court.
  3. Hours later: ABC suspended Jimmy Kimmel Live!, and Nexstar and Sinclair announced that they would preempt the program on their stations.
  4. September 18, 2025: FCC Commissioner Anna M. Gomez issued a statement responding to ABC’s decision (see below).
  5. September 22, 2025: Disney announced that the program would return to ABC. The network suspension was therefore temporary.
  6. After the network return: according to the senators’ letter, Nexstar and Sinclair continued refusing to air the program on stations they own. That is a separate decision from ABC’s, and it is reported as the senators’ account.

Who made which decision

The dispute turns on separating the actors. The table below shows what each one did and the source for each claim.

Why the “censorship” label is contested

A network’s programming decision is private conduct. Politicians objecting to a show does not, by itself, turn that decision into government censorship. The legal question is narrower: did an official use regulatory authority, or threaten adverse action, in a way that could reasonably be understood as coercion to suppress speech?

The coercion test from NRA v. Vullo

The Supreme Court’s May 30, 2024 decision in National Rifle Association of America v. Vullo is the controlling framework. A plaintiff must plausibly allege that an official’s conduct, viewed in context, could reasonably be understood to convey a threat of adverse government action intended to punish or suppress speech. The Court pointed to three contextual factors: the official’s authority, what the official actually said, and how the target responded. The decision addressed a dispute over a regulator’s pressure on insurers and did not decide the ABC dispute, so applying it here is an open argument rather than settled law.

The timing argument

The strongest link between Carr’s remarks and the suspension is chronological: the warning came on September 17, and ABC acted within hours. Critics treat that sequence as evidence that the warning drove the decision. Supporters of the broadcasters can point out that a warning is not a directive, that no formal FCC order to suspend the program has been reported, and that the network reversed course within days. Both readings rely on the same sequence, which is why the timing alone does not settle the legal question.

The case for the label and the case against

  • For the label: the regulator that licenses the stations publicly tied its remarks to the program’s content; the affiliate preemptions followed the same warning; and the Commissioner’s own statement treats the suspension as government-driven.
  • Against the label: the immediate programming decisions were made by private companies; the reported words were a warning about future action rather than a formal order; and the most detailed account of the words comes from senators who are critics of the chairman, which makes it a partisan account until tested in a proceeding.

Gomez’s statement

In her September 18, 2025 statement responding to ABC’s decision, Commissioner Gomez wrote: “This FCC does not have the authority, the ability, or the constitutional right to police content or punish broadcasters for speech the government dislikes.” It is the clearest official statement from inside the Commission, but it is one commissioner’s view and does not bind the agency or any court.

Legal status as of October 8, 2026

ABC and Disney sued the FCC and Carr in August 2026 after the Commission ordered eight ABC-owned stations to submit license-renewal applications years ahead of schedule. That suit concerns the early license review, not the 2025 suspension itself, but it is part of the same conflict between the network and the regulator.

On October 6, 2026, a federal judge heard ABC’s request for an injunction against the early review, according to an Associated Press report from that date. The government disputed the court’s jurisdiction and ABC’s First Amendment arguments. The judge had not ruled when the report was published. The report said a ruling was not expected until at least mid-October, with the government’s additional brief due October 9 and ABC’s due October 14. No court had decided whether the 2025 suspension was unconstitutional.
