Gutmann, 97, died weeks later from complications of the injury. The medical examiner classified the death as a homicide, but prosecutors filed no charges, saying Gagne lacked the mental capacity to intend harm.
What happened to Helmut Gutmann?
On January 26, 2009, Gagne and Gutmann were involved in an altercation at the memory-loss unit of Friendship Village in Bloomington. Gutmann suffered a broken right hip in the clash, according to the Minnesota Star Tribune.
Gutmann died on February 14 from complications of the injury. His daughter, Ruth Hennig, described him as a widely respected scientist and musician. She said she did not blame Gagne, whom she understood to have Alzheimer’s disease, and that the family believed prosecution would be inhumane.
Why was Gutmann’s death classified as a homicide?
The Hennepin County medical examiner said Gutmann “died from complications from a right hip fracture due to a fall” after being “pushed by another.” On February 25, the Star Tribune reported the medical examiner’s homicide classification while police were still investigating and prosecutors had not yet decided whether to file charges.

Roberta Geiselhart, investigations supervisor for the Hennepin County medical examiner, explained that the classification concerns how a death occurred, not whether the person responsible intended to cause it: “Medical examiners will use ‘homicide’ in very pure terms,” she said. “We do not enter at all into intent. That is more of a legal matter.”
In this case, “homicide” was a medical manner-of-death classification. It was not a criminal conviction or a finding that Gagne had committed murder.

Why wasn’t Verne Gagne charged?
On March 13, 2009, Hennepin County Attorney Mike Freeman announced that Gagne would not be charged. The Associated Press report carried by Fox News said Freeman concluded that Gagne lacked the mental capacity necessary to intend harm to Gutmann. Freeman said bringing charges would have been “unjust”; the report described his conclusion as “not a crime.”
That was the prosecutor’s decision in this case, not a court ruling. The materials reported at the time do not establish a judicial judgment on the incident. The no-charge outcome does not undo the medical examiner’s finding about the fatal injury; it addresses the separate question of whether criminal charges were appropriate given Gagne’s mental capacity.

Who was Verne Gagne?
Gagne was a prominent amateur and professional wrestler who later became a promoter. WWE’s biography of Gagne lists two NCAA wrestling championships and four Big Ten championships, and says he was inducted into the WWE Hall of Fame in 2006.
The Washington Post obituary reports that he held the AWA World Heavyweight Championship ten times between 1960 and 1981. Gagne died in 2015 at age 89.

Why this remains a tragic story
The reports describe a fatal injury, a medical examiner’s homicide classification, and a prosecutor’s decision not to charge a man who lacked the mental capacity to intend harm. They also record the perspective of Gutmann’s daughter, who acknowledged Gagne’s responsibility for the fatal injury while saying she did not blame him. The distinction between the medical finding and the legal decision is essential to understanding the case without turning its outcome into a claim of criminal guilt.
