Donald Trump publicly threatened legal action against ABC shortly before Jimmy Kimmel Live! returned on September 23, 2025, after the network suspended the show. The available reporting establishes a threat, not a lawsuit filed by Trump over Kimmel’s return. ABC and Disney later brought a separate case against the Federal Communications Commission over broadcast-license reviews; that litigation is not the threatened suit.
Why ABC suspended Jimmy Kimmel’s show
ABC suspended Jimmy Kimmel Live! after Kimmel made comments in the wake of the killing of Charlie Kirk. The suspension was a network programming decision. The reporting available here does not establish a fuller account of ABC’s internal reasoning or the specific legal basis for the suspension.
When the show returned and what Trump said
The program returned on September 23, 2025. Shortly before the broadcast, Trump criticized ABC for giving Kimmel his job back, attacked the network’s programming, and threatened legal action, according to The Associated Press and Semafor. The reports establish the public threat, but not a specific legal theory. They should not be read as evidence that Trump filed a case.
Kimmel addressed the suspension and Trump’s reaction during his return broadcast. AP reported that Kimmel criticized Trump for celebrating people losing their livelihoods over speech he disliked. Semafor reported Kimmel saying that “a government threat to silence a comedian the president doesn’t like is anti-American”; that is a reported quotation, rather than an independently verified transcript excerpt.

Did Trump actually sue ABC?
The reporting cited here does not establish that Trump filed a lawsuit against ABC over Kimmel’s reinstatement. A public threat to sue and a filed lawsuit are different things. The evidence supports saying Trump threatened legal action; it does not support saying he sued, or describing a case, court, or legal claim arising from that threat.
How ABC and Disney’s later FCC lawsuit differs
In a separate dispute in 2026, the FCC ordered an early review of licenses held by ABC-owned stations, citing diversity and inclusion practices. ABC, Disney, and the affected stations sued the FCC in August 2026. That case concerns the regulator’s review of broadcast licenses—not Trump’s 2025 threat over Kimmel’s return. Reuters reported on the license dispute.

On October 6, 2026, a federal judge heard ABC’s request for a preliminary injunction in the FCC case and did not immediately rule, according to The Associated Press. That procedural development is part of the later regulatory litigation; it does not change the distinction between ABC’s actions concerning the program, Trump’s public threat, and the companies’ suit against the FCC.
