Yes. TikTok remains available in the United States after the establishment of TikTok USDS Joint Venture LLC on January 22, 2026. The new entity operates the U.S. business under a majority American-owned structure; ByteDance retains a 19.9% stake. This is a restructuring of TikTok’s U.S. operations, not a sale of ByteDance or the global TikTok business.
What the deal changed
The joint venture formalized a U.S. structure intended to satisfy the Protecting Americans from Foreign Adversary Controlled Applications Act, the 2024 law that required ByteDance to divest TikTok’s U.S. operations or face restrictions that would make the app unavailable. The White House said the structure qualified as a divestiture and would separate the U.S. operation from foreign-adversary control. The venture says it is responsible for U.S. data protection, algorithm security, content moderation, and software assurance. The White House’s September 2025 order describes the proposed framework; Silver Lake’s January 2026 announcement confirms the venture’s establishment.
Who owns the U.S. operation?
The publicly announced ownership is a mix of three managing investors, ByteDance, and other investors. The White House described the venture as having a seven-member board and said ByteDance could select one director.

Why TikTok faced a U.S. ban
The 2024 law targeted covered applications controlled by entities associated with a foreign adversary. For TikTok, the dispute concerned whether ByteDance’s ownership and relationship to China could expose U.S. user data or allow foreign influence through a large recommendation-driven platform. It also raised questions about the practical separation of a globally integrated service.
The law’s national-security rationale is not proof that TikTok was spying on every American user. The dispute also involved objections about government power and free expression, and the difficulty of separating ownership, data, software, and algorithmic control. The statute and its initial enforcement delay are described in the White House’s January 2025 order; the Justice Department lists the statute among its public actions.

- January 19, 2025: Around the law’s effective date, TikTok briefly became unavailable in the United States. It returned after assurances from the incoming administration that enforcement would be delayed.
- January–September 2025: The administration extended the enforcement delay while negotiations continued.
- September 25, 2025: The White House announced an executive-order framework for a U.S. joint venture. This was the framework stage, not the date the venture was established.
- January 22, 2026: TikTok USDS Joint Venture LLC was established, turning the announced structure into an operating U.S. entity.
What changes for users?
Access and the app
The arrangement was designed to keep the existing U.S. TikTok experience operating. The cited announcements do not establish a mandatory nationwide replacement app for ordinary users. A corporate restructuring is not itself an instruction to download a new app; users should rely on TikTok’s notices and the official app-store listing, not unofficial apps claiming to be an American replacement.
Data and security
The venture and the White House describe safeguards for U.S. data and security, including Oracle’s role as security provider and use of an Oracle U.S. cloud environment. These are commitments and institutional arrangements, not an absolute guarantee that data is risk-free. The public announcements do not disclose every technical control or contract term.

Feed, moderation, and privacy
The venture’s stated remit includes algorithm security, content moderation, and software assurance. That leaves room for future changes in how recommendations, moderation, privacy terms, or features are governed. The announcements do not establish an immediate consumer-facing redesign or predictably different feed.
What happens to TikTok’s recommendation algorithm?
The deal places algorithm security within the new venture’s safeguards, but that does not establish that every part of TikTok’s global recommendation technology was transferred outright to an American owner. The Justice Department’s Office of Legal Counsel later said the venture had revised the recommendation algorithm and cybersecurity program in the context of a separate federal-government-device prohibition. Public reporting has described the technology relationship in terms of licensing, security controls, and revision rather than a simple transfer of all underlying intellectual property. MediaGazer’s September 2025 coverage reflects that distinction. The publicly available descriptions do not fully specify who approves every model update, how training is handled, or how all licensing boundaries work. Oracle’s infrastructure and monitoring role should not be confused with proof that Oracle owns or independently writes the global algorithm.

The immediate effect is continuity: creators, advertisers, and businesses can continue using TikTok in the U.S. The joint venture cited more than 200 million Americans and 7.5 million businesses as participants in the platform. That does not guarantee unchanged reach, policies, monetization, or commerce arrangements over time.

Does ByteDance still control TikTok in the U.S.?
Under the announced structure, ByteDance no longer has controlling ownership of the U.S. venture: it holds 19.9%, and the White House said it could select only one of seven directors and would be excluded from the security committee. The administration’s position is that the U.S. venture operates independently. That formal position is different from saying ByteDance has no connection at all: it remains a shareholder, and the public descriptions do not reveal every technology, licensing, or commercial boundary between the U.S. operation and the global platform.
What remains unsettled
- Full contractual terms: Public announcements do not detail every agreement or operational boundary.
- Technology governance: The precise arrangements for licensing, model updates, training, and software changes are not fully described publicly.
- Long-term independence: Ownership percentages do not, by themselves, answer every question about practical control and enforcement.
- Product differences: U.S. and international versions could diverge in policy or features, but the announcements do not establish how or when.
- Future scrutiny: Congress, courts, or a future administration could revisit the arrangement or its enforcement.
The White House determined that the proposed structure met the law’s divestiture requirements; that administrative determination does not mean legal and policy controversy has disappeared. The September 2025 framework and the completed January 2026 venture should also be kept distinct: the first announced a path, while the second established the U.S. entity.
