Gambit’s release from Apocalypse’s control is resolved in X-Men (2004) #187, the epilogue to the “Blood of Apocalypse” storyline. Sunfire breaks free first, takes Gambit with him, and uses his flame powers to free Remy from his Horseman conditioning. That ends Apocalypse’s control; it does not establish that every trace of the Death persona vanished forever.
What happens in X-Men (2004) #187?
Apocalypse transforms Gambit into the Horseman Death during “Blood of Apocalypse.” In the story’s aftermath, Sunfire escapes Apocalypse’s control and flees with Gambit. Marvel’s Gambit character biography says Sunfire “freed Remy from his Horseman conditioning by using his flame powers.”
The arc runs through X-Men (2004) #182–187. Issue #187 is the epilogue and the best issue-level answer to when Gambit stops being Apocalypse’s controlled Horseman. Marvel’s official listing identifies the 2004 series and its #182 issue (Marvel’s X-Men #182 page); issue guides describe #187 as the epilogue and cover the Sunfire-and-Gambit aftermath (issue guide; issue guide).
Does that mean Gambit stopped being Death forever?
Not necessarily. The specific event in #187 is Sunfire freeing Remy from Apocalypse’s conditioning. That is more precise than saying the Death persona was erased permanently: later stories may still draw on residual aspects of that identity.

Is X-Men #95 the issue where Gambit is freed?
No. X-Men (1991) #95 is an earlier, separate reveal of the identity of Horseman Death, not the issue that ends Apocalypse’s control of Gambit. Marvel lists that issue with a publication date of December 1, 1999 (Marvel’s X-Men #95 listing).
