Abby Lee Miller’s 2025 lawsuit alleged that a catheter was left inside her after spinal surgery and went undiscovered for years. The allegation has not been established in court. What Miller’s 2025 lawsuit alleged
The Independent reported that Miller filed suit on June 3, 2025, in Los Angeles County Superior Court, naming Cedars-Sinai Marina Del Rey Hospital and physicians. The complaint, as summarized in that report, alleged medical negligence, professional negligence and medical battery. These were claims in a lawsuit, not findings of liability. According to the complaint details reported by The Independent, Miller had spinal surgery in 2020, experienced abdominal pain afterward and allegedly had a CT scan in June 2024 that found a retained catheter. The report said the object was removed that same day. These details are allegations as reported; no medical records were independently reviewed.
The Independent reported that Miller sought $1.4 million in damages. That figure was a demand, not a court award or confirmed settlement.

What changed in August 2026
On August 31, 2026, Becker’s Spine Review reported that Miller dropped spine surgeons Hooman Melamed, MD, and Paul Dwan, MD, as defendants. It said she acknowledged the doctors were not at fault for the retained object and that claims they left it were “made without factual bases.” Becker’s Spine Review’s report
TMZ reported on August 26, 2026, that Miller sought dismissal of the doctors and Cedars-Sinai Marina Hospital, retracted negative past statements about the two doctors and acknowledged they were not at fault. TMZ also said her lawyer planned to file a lawsuit against other defendants, without naming them or giving a filing date. A request to dismiss is not proof that a judge entered an order. Is the case still active?
The available August 2026 news reports do not verify the current court docket, whether a judge granted any dismissal request, whether a further lawsuit was filed, or whether the original medical allegations were adjudicated. It is therefore not possible to say from these reports alone that the entire case is currently active or dismissed.
