Police and prosecutors said 13-year-old Derek Rosa confessed in a 911 call and a recorded police interview after his mother, Irina Garcia, was killed in their Hialeah home on October 12, 2023. In January 2026, a judge ruled that the police confession could be used at trial. Rosa pleaded guilty before trial began, however, so no jury heard it. He pleaded guilty to second-degree murder on January 16, 2026, and was sentenced to 25 years in prison followed by 20 years of probation, according to local reporting.
What did Derek Rosa confess?
Authorities attributed statements to Rosa in both a 911 call and a recorded police interview. The available reporting establishes that those statements were described as a confession, but does not provide a complete primary-source transcript or recording. The case began with a first-degree murder charge after Garcia was killed at the family’s Hialeah home on October 12, 2023, when Rosa was 13. Local 10’s 2023 report described the arrest and the authorities’ account.
In reporting on the state’s account, the Miami Herald said police and prosecutors cited 46 stab wounds. That figure is attributed to authorities; it was not a fact established through a jury verdict, because the case ended in a guilty plea before trial. The Miami Herald’s January 2026 report covered the case’s final proceedings.
Why did the defense challenge the police confession?
At a January 2026 hearing on whether Rosa’s police statements should be suppressed, the defense argued that his age and maturity affected whether he understood what was happening. It also questioned the absence of a parental figure during questioning. These were defense arguments about the circumstances and validity of his statements, not a finding that the confession was coerced.

Detective Joseph Elosegui testified that he explained terms including “attorney” and “coercion” to Rosa. The judge considered the challenge and ruled that the confession could be used in the trial then scheduled to begin January 20. The hearing and ruling were reported by the Miami Herald.
Could a jury hear the confession?
The judge ruled that the confession was admissible for the scheduled trial. That ruling meant prosecutors could use it at trial; it did not mean a jury actually heard it. On January 16, before the trial began, Rosa pleaded guilty to second-degree murder. Because the case ended with that plea, there was no jury trial at which the confession was played.

At the plea proceeding, Rosa’s stepfather, Frank Ramos, said: “Nothing justifies what you did,” according to Local 10’s January 16 report.

The 2025 appellate opinion concerned trial-court orders about disclosure of confidential medical and related records. The Third District Court of Appeal quashed those orders, finding that no compelling governmental interest had been shown in the circumstances. Although the opinion recounted aspects of Rosa’s detention, its holding was about records and privacy—not whether his confession was admissible or whether he was guilty.
