RTÉ’s upcoming documentary Fertility Uncovered asks whether people seeking fertility care in Ireland are adequately protected. It is scheduled for Wednesday, 7 October 2026, at 9.35pm on RTÉ One and RTÉ Player. RTÉ’s announcement previews its investigation; it is not the programme itself or a regulator’s finding.
What is Fertility Uncovered about?
RTÉ says RTÉ Investigates: Fertility Uncovered follows couples seeking state assistance and examines a fertility sector it describes as not yet fully regulated. The broadcaster says its year-long investigation includes undercover filming concerning the promotion of controversial treatments. Its announcement does not give an exact start date for that investigation or establish the programme’s findings in full.
The framing question is whether, when fertility struggles lead people to seek medical help, the State is properly protecting them. That question matters because access to publicly funded treatment, the law’s intended safeguards and the regulator’s operational capacity are separate issues.
What does the 2024 law provide, and what is in place now?
The Health (Assisted Human Reproduction) Act 2024 was enacted on 2 July 2024. It provides for a regulatory framework overseen by the Assisted Human Reproduction Regulatory Authority (AHRRA), including licensing and oversight of providers and provisions concerning information rights for people born following assisted human reproduction. The Act also covers areas including donation, surrogacy and research. Enactment establishes the legal framework; it does not by itself show that every provision has commenced or is being enforced.

The Act includes specific protections. For example, section 17 provides for a child-safety assessment for providers in the situations it covers. Whether a particular safeguard is currently enforceable depends on commencement and implementation of the relevant provisions.
A regulator has been established, but the rollout is phased
The Department of Health announced AHRRA’s establishment and the appointment of its first chairperson on 13 October 2025. A 2026 public procurement notice describes the authority as still building its capacity. The notice envisages preparatory work during 2026–27 and phased public services from early 2028; that is a projected schedule, not confirmation that the milestones will be met.
RTÉ’s description of the sector as not yet fully regulated should therefore be read as the broadcaster’s preview of its investigation. The existence of AHRRA and the 2024 Act is significant, but neither alone demonstrates that the full licensing and oversight system is already operational.
Is fertility treatment publicly funded in Ireland?
Yes, publicly funded assisted reproduction treatment has been available through an HSE pathway since referrals began in September 2023. It is not universal direct access to IVF. Patients start with a GP or consultant and are referred to a Regional Fertility Hub for assessment. The hub determines suitable care; not everyone needs IVF. Where advanced treatment is indicated, eligible patients may be referred to approved providers for publicly funded IVF or ICSI, and some groups may be offered IUI.

Eligibility is conditional
The HSE criteria include ordinary residence in the Republic of Ireland, referral and clinical assessment, age limits, previous assisted reproduction treatment, children, the number of intending parents, relationship duration, sterilisation and BMI. The HSE’s eligibility guidance was last reviewed on 30 June 2025, so patients should check the current criteria with the HSE or their referring clinician.
On 30 June 2025, the Department of Health announced an eligibility extension allowing qualifying couples with one existing child in their relationship to access publicly funded treatment, subject to all other criteria. This change did not remove the pathway’s other conditions.
What is the concern about fertility preservation?
Fertility preservation—such as preserving eggs before a condition or treatment may affect fertility—is a distinct access question from publicly funded IVF. RTÉ’s announcement identifies Katie, a 30-year-old with endometriosis from Galway, and says she felt she had no option but to travel abroad for egg preservation because it was not publicly funded for endometriosis patients in Ireland. She told RTÉ, “Our system is failing young women.” This is her account, not evidence that every person with endometriosis has the same clinical need or options.
Separately, HIQA’s 2024 review reported that Ireland then had no publicly funded fertility-preservation services for non-cancer patient groups. That is a dated finding, not a verified account of provision in 2026. The policy issue is whether medically indicated preservation is funded and accessible beyond the cancer pathway; individual decisions depend on clinical circumstances.

What perspectives does the documentary preview include?
RTÉ also quotes Caitríona Fitzpatrick, spokesperson for the National Infertility Support and Information Group (NISIG): “In the last five years there has been huge growth in this industry but there has to be oversight of it.” The statement is attributed to Fitzpatrick in RTÉ’s announcement. The documentary’s scheduled broadcast may provide further reporting and context; the preview alone cannot establish the truth of every allegation or show the regulator’s findings.
