Paying for an artwork file does not automatically give you its copyright. A clear brief and rights agreement help prevent disputes when you reuse stream graphics on VODs, social posts, merchandise, or other platforms.
1. Define the assets and how you will use them
Start with the channel and its audience: describe the subject, tone, visual references, and where each item will appear. For a documentary-focused channel, for example, an overlay may need to keep the footage readable and leave room for captions or source credits. Explain the intended use rather than asking an artist to infer it.
List each deliverable separately. Possible items include a logo, avatar, stream overlay, starting screen, panels, alerts, emotes, animated stinger, or original music. For every item, specify:
- Where it will appear: a Twitch live stream, VODs and clips, social promotion, YouTube or another platform, sponsor placements, merchandise, or paid advertising.
- Technical needs: dimensions, file format, transparency, animation length and format, and any platform constraints you already know.
- Whether you need editable/source files, and which dependencies—such as fonts, stock images, premade elements, or samples—are included.
- Whether the artist may show the finished work in a portfolio, and whether you expect credit.
These are planning points, not a universal form required by Twitch or a law. Confirm the actual specifications for the platform and placements you intend to use.

2. Agree on process, revisions, timing, and payment
Set the working process before commissioning begins. Identify milestones such as a concept sketch, design review, near-final proof, and final delivery. State how many revision rounds are included, what counts as a revision rather than a new request, how approval is given, and what happens if a deadline or payment milestone is missed. Put the schedule and payment stages in the agreement; there is no established market-wide standard for delivery times, revision counts, or commission prices.
Compare proposals on style and portfolio fit, technical readiness, schedule, revision process, source-file and third-party-material terms, and the license scope included in the quoted fee. Compare the total price for the uses you need, not just the price of the initial image or audio file.

3. Choose the copyright and license arrangement
Make an explicit choice between a license and a transfer of rights. Under a license, the artist generally retains copyright while giving you permission for defined uses. A transfer is a different arrangement and should be stated clearly in writing. The U.S. Copyright Office says, “Generally, the author and initial copyright owner of visual or graphic art is the person who makes the work.” It also explains that transferring ownership of a physical copy does not, by itself, transfer copyright; a copyright transfer generally requires a signed writing. See the U.S. Copyright Act and the Copyright Office’s guidance for visual and graphic artists.
List permissions one by one. Decide whether the agreement covers live streams, VODs and clips, social posts, other platforms, sponsor placements, merchandise, paid ads, edits or derivative versions, and sharing files with editors or production vendors. Address exclusivity and portfolio display as well. If you want broad commercial or exclusive rights, negotiate the scope and fee and record both in the agreement.

Do not rely on “work made for hire” wording alone
In the United States, a commissioned work is not automatically a work made for hire because a contract uses that label. The U.S. Copyright Office says the arrangement must meet statutory conditions, including a signed written agreement and an eligible category of work; it notes that most visual arts works do not fit the commissioned-work categories. If ownership matters, spell out the intended license or transfer rather than assuming the label settles it. This is general U.S.-specific information, not legal advice about a particular commission. 4. Check embedded material and music rights
Ask whether the work includes stock images, fonts, premade elements, samples, or contributions from collaborators. Confirm that the relevant permissions allow the specific channel and commercial uses in your brief. A creator may not control every right in material incorporated into a design or track.

For music, verify that the composer or vendor can authorize the uses you need on Twitch. Buying a track or subscribing to a music service does not, by itself, establish that it is cleared for your stream. Twitch warns that permission from an artist may not cover all necessary rights and states: “Even when you’re using an Extension, you are responsible for ensuring you have the necessary rights to any music used in content on your channel.” Read its current DMCA and copyright FAQs and confirm the permission directly with the rights holder or vendor.

Keep the signed agreement, payment records, final files, and written permissions together somewhere you can retrieve them if a copyright claim arises. Twitch says it acts on complete copyright notifications and generally considers a user a repeat infringer after three copyright strikes; that policy figure is not a prediction of what will happen to an individual channel. Check Twitch’s current Terms of Service and copyright guidance: content uploaded to Twitch is subject to a broad platform license under its terms, and policies may change.

When sponsor branding is part of the stream
Twitch lists brand-logo stream overlays as branded content. Its guidance says streamers are not expected to use the branded-content tool unless the branding is a central and intentional element of the livestream. For a specific sponsorship, check Twitch’s current branded-content guidance and disclose the relationship appropriately.
