Why Stealing Scarlett Johansson’s Voice for ChatGPT Was Brilliant—and Reckless

OpenAI did not need Scarlett Johansson’s literal recording to borrow the cultural meaning of her voice. The “Sky” voice made GPT-4o instantly legible: warm, witty, flirtatious and emotionally available, like the artificial intelligence Johansson voiced in Her. That was exceptional product design and launch marketing. It was also a communications, consent and reputational failure because OpenAI encouraged the association while relying on the narrow defense that Sky was performed by someone else.

The voice sold a relationship, not a specification

“Real-time multimodal interaction” is difficult to demonstrate in a press event. A familiar-sounding conversational partner is not. Sky communicated interruption handling, speed, humor, responsiveness and emotional warmth before OpenAI explained the underlying model.

That changed GPT-4o’s apparent category. It sounded less like a search box or dictation tool and more like a participant in a conversation. For nontechnical users, the voice lowered the learning curve; for existing users, it made voice mode memorable. OpenAI described smoother turn-taking, background-noise filtering, tone adaptation and group conversation as part of the new experience (OpenAI’s account of the voice-selection process).

The voice also supplied a ready-made story. Her had already shown audiences an AI that listens, jokes, interrupts, attracts emotional attachment and blurs the line between assistant and companion. GPT-4o did not have to explain those implications from scratch.

Why the strategy was commercially brilliant

It converted capability into cultural shorthand

A neutral synthetic voice could prove that speech recognition worked. A warm, human performance suggested what users might feel while using the system. That distinction matters in a category whose success depends on repeated, socially comfortable use rather than a single accurate answer.

It made the launch travel

“Sky sounds like Scarlett Johansson” was more shareable than “OpenAI improved speech-to-speech latency.” The dispute reached people who had not watched the GPT-4o presentation. This created an attention paradox: the demonstration generated extraordinary awareness, but the same association became the launch’s largest liability.

It gave GPT-4o a product identity

Text interfaces are increasingly difficult to distinguish. Voice can become a recognizable identity in the way Siri, Alexa or a famous narrator can. That makes voice both a software feature and a potentially identity-bearing performance—the tension at the center of the controversy.

What happened: a precise timeline

Date Event
September 2023 OpenAI introduced ChatGPT voice capabilities with Breeze, Cove, Ember, Juniper and Sky.
September 2023 Johansson says Sam Altman approached her about voicing ChatGPT and that she declined (Sky News).
May 10, 2024 OpenAI says Altman contacted Johansson’s team again to ask whether she might reconsider.
May 13, 2024 OpenAI introduced GPT-4o. Altman posted “her,” widely interpreted as a reference to the film.
May 19, 2024 OpenAI paused Sky, saying it did so out of respect for Johansson’s concerns.
May 20–22, 2024 Johansson publicly objected; OpenAI published its casting explanation and denied that Sky was her voice.

Johansson described the resemblance as “eerily similar” in an account reported by the Associated Press. OpenAI said Sky was performed by another professional actress, that casting occurred before Johansson was contacted, and that the voice was not intended to resemble her (OpenAI).

Was Sky actually Scarlett Johansson’s voice?

Three different claims are often collapsed into one:

  • OpenAI used Johansson’s recording: this has not been established by the material reviewed here. The Washington Post reported that records and interviews it reviewed did not show a direct clone.
  • Sky sounded like Johansson: this is the documented public dispute. Johansson, users and media commentators made that comparison; it is not the same as an audio-forensic finding of identity.
  • OpenAI deliberately designed Sky to evoke Johansson: this remains an unresolved allegation. Prior outreach, the timing of the May 10 contact and the “her” post support suspicion, while OpenAI’s casting timeline and its denial support the competing account.

The most defensible conclusion is that OpenAI created a separately recorded voice that audiences interpreted as Johansson-like, then launched it in a presentation that reinforced the Her association. Whether that resemblance was intentional is not proven by the available evidence.

Why Altman’s “her” post changed the meaning

The one-word post was efficient branding and poor risk management. It may have referred to the film’s premise rather than Johansson herself, but it gave audiences a reason to treat the vocal resemblance as a deliberate signal. Coverage of the suspension shows how quickly that interpretation became central.

OpenAI’s marketing benefited from the cultural comparison; its response depended on the technical distinction that Sky was not Johansson’s actual voice. The company could be correct in that narrow sense and still lose the broader argument about what it intended audiences to imagine.

The legal question is identity, not simply copyright

Right of publicity and false endorsement

The leading theory is unauthorized commercial use of a recognizable identity or persona: did the overall presentation make a reasonable audience identify the voice with Johansson, suggesting her endorsement or participation? The answer would depend on jurisdiction, distinctiveness, intent, commercial use and evidence. A Georgetown legal analysis identifies voice-based right-of-publicity issues as the central question.

The Bette Midler analogy

In Midler v. Ford Motor Co., Ford hired a singer to imitate Bette Midler’s distinctive singing voice after Midler declined to appear. The case matters because imitation, not use of the original recording, was the issue. It does not automatically determine a result involving generative AI, but it shows why “we did not copy the file” is not a complete legal answer.

What copyright does—and does not—settle

A copyrighted sound recording or fixed performance is different from a person’s general vocal identity. Depending on the facts, claims could instead involve publicity, misappropriation, false endorsement, contract or unfair competition. State protections remain uneven; there is no single federal rule that resolves every AI voice imitation dispute.

Labor and union protections

SAG-AFTRA supported Johansson’s demand for transparency and connected the dispute to federal protections for voices and likenesses from unauthorized digital replication (union statement; AI policy resources). The available material does not establish a final lawsuit judgment or settlement.

The overlooked performer and ethics problem

OpenAI said the voices were performed by professional actors, compensated above top-market rates, and that it could not disclose their names for privacy reasons. That answer protects the performer’s privacy but leaves an ethical problem unresolved: a working actor’s performance became valuable partly because listeners thought it belonged to a celebrity.

Consent from the actor who recorded Sky may authorize that performance. It does not necessarily authorize marketing that evokes another person’s identity. Conversely, Johansson cannot be treated as owning every low, breathy or conversational voice. The relevant distinction is between a distinctive persona and a general vocal style.

Why the launch became a strategic self-own

  • The association was too obvious. The more effective the Her callback, the less convincing a purely technical denial became.
  • Prior outreach changed the context. Johansson’s account created a damaging sequence: she says she declined, a similar voice appeared, and Altman referenced Her at launch.
  • Safety messaging collided with conduct. OpenAI was discussing the risks of increasingly realistic AI while appearing to demonstrate a consent and identity problem.
  • Reach became distrust. The controversy generated attention, but it displaced GPT-4o’s capabilities and weakened confidence in OpenAI’s judgment.

What a safer launch would have looked like

  1. Choose a voice with a clearly distinct profile rather than one that predictably evokes a living celebrity.
  2. Publish voice-selection, consent and future-use principles before the launch.
  3. Avoid a one-word Her reference that turns an ambiguous resemblance into a perceived signal of intent.
  4. Give the performer contractual control over reuse, modification, disclosure and withdrawal.
  5. Explain how the company distinguishes ordinary vocal qualities from deliberate persona imitation.

The verdict

Calling this “voice theft” as an established fact goes beyond the evidence. Calling it harmless because another actor recorded Sky misses the central issue. OpenAI found the fastest way to make conversational AI emotionally legible: it borrowed the cultural meaning attached to Johansson and Her without needing Johansson’s literal audio.

That was brilliant product design and launch marketing. It was reckless ethics, communications, rights management and reputational strategy. The more successfully a voice makes software feel like someone, the more seriously consent, likeness and performer control must be treated.
