Ruby’s actions on November 24, 1963
Ruby shot Oswald in the basement of the Dallas Police Department as police were moving the accused presidential assassin in front of reporters and other members of the public. The Warren Commission placed the shooting at 11:21 a.m. and found that Ruby entered the area shortly after 11:17 a.m.
The Commission’s reconstruction placed Ruby at a nearby Western Union office shortly before the shooting. It identified the Main Street ramp as his most likely route into the basement, while acknowledging that the evidence did not establish that route with absolute certainty. Ruby was arrested at the scene.
A preventable security breakdown
The Commission criticized the decision to move Oswald in full public view after threats had been made against him. It found the basement had not been cleared and that the transfer arrangements were inadequate, concluding that these failures contributed to Oswald’s death. That conclusion is different from claiming that police helped Ruby; the Commission said it found no evidence of police assistance.

Why Ruby was never retried
The appellate reversal did not erase the original events or guarantee Ruby would be acquitted. It meant the conviction and death sentence could not stand and that a new trial was required. Ruby remained in custody awaiting that proceeding, but his illness became terminal. He died before prosecutors could try the case again, so Texas never carried out the death sentence and Ruby never received a retrial.
What the Warren Commission concluded
The President’s Commission on the Assassination of President Kennedy investigated Oswald’s killing as part of its broader inquiry. Its report stated: “The Commission has found no evidence that Jack Ruby acted with any other person in the killing of Lee Harvey Oswald.” It also found no direct or indirect relationship between Ruby and Oswald.

That is a finding about the evidence available to the Commission, not proof that every possible theory was impossible. The report acknowledged that proving a negative is difficult: evidence that another person was involved might have remained beyond investigative agencies’ reach and had not come to the Commission’s attention. The commission’s conclusion therefore should not be converted into an absolute claim that no one else could have been involved.
The Commission also explained that Oswald’s death made it impossible to obtain the complete story through ordinary judicial proceedings in a trial of the alleged assassin. Ruby’s prosecution and the Commission investigation consequently became the principal official records used to reconstruct what happened.

Ruby’s final months
Ruby spent the period after his conviction pursuing an appeal and awaiting the new trial ordered in 1966. A Library of Congress catalog record for a September 9, 1965, note to his attorney, Elmer Gertz, describes worsening delusions during this period. That catalog description is contextual evidence about his reported mental state, not a basis for assigning a medical diagnosis beyond the record.
Ruby’s physical condition ultimately prevented the legal process from continuing. He died at Parkland Memorial Hospital on January 3, 1967, from cancer, roughly two months after the appellate reversal and before any new jury could hear the case.
