Pornhub did withdraw access from Nebraska in 2024. The site’s decision followed Nebraska’s enactment of LB 1092, the Online Age Verification Liability Act, which required covered commercial websites to verify that users were at least 18. Nebraska did not directly ban or shut down Pornhub; Pornhub chose to stop serving Nebraska users rather than implement the required system.
What happened?
On June 20, 2024, Nebraska Gov. Jim Pillen’s office announced that Pornhub would “go dark” in the state after LB 1092 took effect. The governor’s office identified July 15, 2024, as the law’s effective date. The announcement came in response to Pornhub’s decision to withdraw access from Nebraska.
Later, the governor’s 2024 recap described Pornhub as having ceased offering access in Nebraska. That means Nebraska residents lost direct access to the platform, including adults who were legally old enough to view the material.

- Users: encountered a statewide loss of direct access to Pornhub.
What did LB 1092 require?
LB 1092 applies to a commercial entity that knowingly publishes or distributes material harmful to minors on a website where that material accounts for more than one-third of the site’s total material. It defines a minor as someone under 18.
A covered website must use a “reasonable age verification method” to confirm that a person attempting to access the material is at least 18. The statute does not mandate that every user upload a driver’s license. Instead, it lists several possible methods, including:
- A digitized identification card, such as a digital copy of a driver’s license.
- Government-issued identification.
- A financial document or another reliable document serving as a proxy for age.
- A commercially reasonable process using public or private transactional data.
The law’s one-third threshold is another important limitation. It does not literally cover every website that contains a single adult image or video. The statute is aimed at commercial websites whose material harmful to minors makes up more than one-third of their overall content. The Nebraska Legislature’s Chapter 87 text contains the definitions and verification requirements.
How does Nebraska define material harmful to minors?
The statute uses a three-part definition. Material is covered when all of the following conditions apply:
- An average person applying contemporary community standards would find that it is designed to appeal to a prurient interest.
- It is patently offensive to prevailing adult-community standards concerning minors.
- Taken as a whole, it lacks serious literary, artistic, political, or scientific value for minors.
That definition is intended to distinguish the material regulated by the law from content that may be sexual or controversial but does not meet the statutory test.

Why did Pornhub withdraw instead of complying?
Pornhub’s withdrawal can be understood as a compliance-versus-access decision. A platform facing the law could introduce an age-verification process for Nebraska users or stop serving the state. Pornhub chose the second option.
Age verification can involve the transmission of government identification, financial information, or other data to a platform or a third-party provider. That creates privacy, cybersecurity, operational, and legal concerns, even when a statute limits how long identifying information may be retained. The law also permits civil lawsuits over certain violations, creating potential liability for covered entities and verification providers.
Those factors help explain why a platform might prefer geoblocking, but the available official sources do not establish that a particular compliance cost, traffic loss, or litigation threat was Pornhub’s confirmed reason. It is more accurate to describe those as likely considerations in the platform’s decision rather than as proven company motives.
What privacy protections did the law include?
LB 1092 says that the commercial entity or third party conducting age verification may not retain identifying information after access has been granted. This is a statutory safeguard, but it does not mean that verification would be entirely risk-free.
A user may still need to transmit identity or transactional information during the verification process. That information could be exposed to risks involving collection, transmission, storage before deletion, third-party processing, or cybersecurity. The statute regulates retention after access; it does not eliminate every privacy concern connected with providing sensitive information.

The law also does not mean that Nebraska itself receives every user’s identification document. The statutory framework addresses covered websites and verification providers rather than establishing that the state collects each user’s ID.
What legal remedies did the law create?
The act creates a private right of action. A person aggrieved by a violation may bring a civil lawsuit and may seek remedies that can include:
- Preliminary or other equitable relief.
- Declaratory relief.
- Actual damages in specified circumstances.
- Attorney’s fees and litigation costs, at the court’s discretion.
The statute allows a minor, or a parent or guardian in certain circumstances, to seek actual damages for access-related violations. It also allows an individual to seek actual damages when identifying information was unlawfully retained. These provisions increased the legal consequences for a covered website or verification provider that failed to follow the law.
What websites and content were exempt?
LB 1092 contains exemptions for news-gathering organizations and bona fide news or public-interest broadcasts, videos, and reports. It also addresses internet utilities that merely provide access or connections to content they did not create, to the extent they are not responsible for the harmful material.
These exemptions help explain why the law was directed at commercial content publishers and distributors rather than ordinary internet service providers or news organizations.

What did Nebraska users experience?
For users connecting from Nebraska, the practical result was geoblocking: the platform could use location information, commonly associated with an internet connection, to deny access from the state. That decision affected adults as well as minors because a broad state-level block generally does not determine the individual user’s age before denying service.
Location-based blocking is not perfectly precise. Border residents may be misidentified because IP geolocation is inaccurate. Mobile-carrier routing can make a device appear to be somewhere other than its physical location, and shared home, business, school, or public Wi-Fi connections may not reveal the individual user’s exact location.
Pornhub’s withdrawal also does not establish that every adult website became unavailable in Nebraska. LB 1092 applies to websites meeting the statutory threshold, and platforms may respond differently by introducing verification, limiting certain content, or blocking Nebraska connections.
Some users may attempt to circumvent location-based restrictions, but the legal and security implications of doing so vary. A blocked platform’s policy does not itself prove that alternative services are compliant, safe, or trustworthy.

Only indirectly. Nebraska later enacted LB 383, the Parental Rights in Social Media Act. That separate law addressed age verification and parental consent for minors opening social-media accounts. It was not the law that caused Pornhub’s 2024 withdrawal.

In 2026, a federal judge preliminarily blocked enforcement of some LB 383 age-verification and parental-consent provisions while allowing other provisions to remain enforceable. The ruling concerned social-media accounts, not Pornhub’s withdrawal under LB 1092. It should not be described as overturning, striking down, or blocking Nebraska’s pornography age-verification law.

Is Pornhub still unavailable in Nebraska?
The official sources establish the 2024 withdrawal and a later statement from the governor’s office that Pornhub had ceased offering access in the state. They do not independently document a later reopening or provide a current Pornhub statement confirming the platform’s status as of September 2026.
Accordingly, the safest current description is that Pornhub withdrew access from Nebraska in 2024. A claim that the site remains permanently blocked would require a current first-party statement or a dated, reproducible access test specifying the tester’s location, network, and result.

“Nebraska banned Pornhub” is convenient shorthand, but it is legally imprecise. The state did not name Pornhub in a shutdown order. Instead, it created obligations for a category of commercial websites, including age verification for covered material and restrictions on retaining identifying information.
Pornhub then made a business and legal choice not to serve Nebraska users under that framework. That choice protected the platform from immediately having to implement the state’s verification process, but it also denied access to adults who could lawfully view the content.
The broader policy debate remains unsettled. Supporters say age verification places responsibility on publishers and can make it harder for minors to access commercial pornography. Critics argue that adults may have to submit sensitive information to view lawful material, that state-level blocking can be inaccurate, and that users could migrate to less reputable services. Whether the law actually reduces minors’ exposure or produces other measurable effects requires evidence beyond the statute and the withdrawal announcement.
