Why does Baby Reindeer include Gadd’s own shame and uncertainty?
Baby Reindeer is not structured as a simple story of an innocent victim and a one-dimensional villain because Gadd has described his own ambivalence, flirtation, shame, internalized prejudice, and delayed responses to both the stalking and the abuse. Those elements are part of the work’s subject: how trauma, fear, masculinity, consent, and shame can affect a person’s decisions and ability to seek help.

These distinctions are not technicalities. The difference between allegedly stalking someone and being convicted of stalking, between inappropriate touching and sexual assault, and between shoving someone and gouging their eyes can change the meaning of a portrayal. Judge R. Gary Klausner highlighted those differences when considering Netflix’s attempt to dismiss the case, as reported in the September 2024 legal coverage.
What did Fiona Harvey’s lawsuit against Netflix claim?
Fiona Harvey filed a federal lawsuit against Netflix in the Central District of California on June 6, 2024. The complaint sought at least $170 million and asserted claims including defamation, intentional infliction of emotional distress, negligence, gross negligence, and violation of publicity rights. The filing is available as the complaint in Harvey v. Netflix.
Harvey’s central argument was that Netflix presented false statements about her as facts, used the opening card This is a true story, and failed to protect her identity despite changing the name to Martha Scott. The complaint also challenged the alleged criminal history, violence, sexual-assault portrayal, and other conduct associated with Martha.
Netflix’s position was that the series was substantially true in the relevant sense and that it was understood as a dramatic work rather than a documentary. Netflix also pointed to end-credit language stating that some elements had been fictionalized for dramatic purposes. Gary Klausner denied Netflix’s motion to dismiss Harvey’s defamation and intentional-infliction-of-emotional-distress claims, while dismissing some other theories, including negligence-related claims and punitive damages at that stage. The decision allowed significant parts of the case to continue; it was not a trial verdict.

A ruling denying dismissal tests whether pleaded claims can proceed, not whether the plaintiff will ultimately win.
