What O’Day did—and did not—say

Those distinctions matter both legally and ethically. An affidavit is a written statement attributed to a witness; it is not, by itself, a judicial determination that the events described occurred. O’Day’s lack of memory does not prove that an assault did or did not happen, and her uncertainty should not be rewritten as a definitive accusation.

O’Day’s earlier relationship with Combs

O’Day became publicly associated with Combs through the MTV reality-television and music project that produced Danity Kane. That denial belongs alongside the allegation, not in a distant or less prominent section. Neither the denial nor the documentary’s presentation of the affidavit resolves the factual dispute. The available reporting does not establish that a court or jury adjudicated this specific allegation involving O’Day.

How the allegation relates to Combs’s federal case

Combs’s federal criminal case was broader than O’Day’s resurfaced account. The U.S. Attorney’s Office for the Southern District of New York charged him with racketeering conspiracy, sex trafficking, and transportation to engage in prostitution.

On July 2, 2025, the jury returned a mixed verdict:

The Justice Department later reported that Combs received a 50-month prison sentence on October 3, 2025. Did Aubrey O’Day testify at the trial?

No. O’Day did not testify in Combs’s federal criminal trial, according to the reporting cited for this account. In May 2025, she said she had been contacted by Homeland Security and had met with investigators, but said she would not testify at that time.

Her decision not to testify does not establish whether the allegation is true or false. It describes her role in the criminal proceeding and prevents readers from treating the federal verdict as a direct judgment on her account.

What is the appeal status?

Combs appealed his criminal judgment. The appeal was expedited, briefing was filed, and the Second Circuit heard oral argument on April 9, 2026. The Associated Press reported that the panel questioned whether the roughly four-year sentence was too severe and did not immediately issue a ruling.

The appellate docket material reviewed for this article showed the appeal activity and the April 9 argument but no final ruling in the retrieved record.
