Can you livestream a class on YouTube if it includes textbook pages, music, or video clips? Not automatically. An educational purpose alone does not clear every copyrighted item in a lesson, and the educational exceptions in India’s Copyright Act are specific rather than a blanket permission for public livestreams, coaching channels, or permanent archives. YouTube also scans live streams for third-party matches and may interrupt a stream. Before going live, identify the material you did not create, check that your rights cover both the live broadcast and any recording, and consider who will be able to watch.
Does an educational purpose make every use of copyright material permissible?
No. The Copyright Act, 1957 includes educational exceptions, but a lesson does not become automatically exempt simply because it teaches a subject. Section 52 includes a provision for reproduction by a teacher or pupil “in the course of instruction.” It also contains a separate provision for certain performances or communications by an educational institution to a defined audience, including staff, students, parents and guardians, and people connected with the institution’s activities.
Those provisions have conditions. They do not state that every public YouTube livestream or recording is permitted because it is educational. Whether a particular use qualifies depends on its facts, including the work used, how it is used, who can access it, and whether it is part of a qualifying course or institutional activity. The cited statutory provisions do not settle every case involving a remote class, an open public stream, a commercial coaching service, or later on-demand access.
That distinction matters for both schools and coaching providers: the teaching purpose is relevant, but it is not, by itself, proof that the use is covered by an exception. For a concrete dispute or a planned use that depends on an exception, seek advice based on the specific material, audience, and distribution arrangement.

What can YouTube do to a live stream that contains third-party material?
YouTube says that all live streams are scanned for matches to third-party content, including another live broadcast. If its systems identify a match, YouTube may replace the stream image with a placeholder, warn the streamer, interrupt the stream, or terminate it if the material remains. A platform action is not a court ruling on whether a use is lawful under Indian law.
A licence does not always prevent an interruption by itself. YouTube advises streamers who have a licence to ask the rights owner to allowlist their channel where applicable; a channel that has not been allowlisted may still encounter a live interruption. YouTube’s livestream terms also require the provider to represent that it has the rights needed to exploit the live content on Google services worldwide and to comply with applicable laws.

Does the answer change if you save the lecture recording?
Yes. Live enforcement and a later claim on an archive are separate events. YouTube says a Content ID claim on a livestream can be made after the stream ends if the creator chose to archive it. Keeping a recording available on demand is therefore a separate publication decision, not merely a continuation of the live class.
Before broadcasting, decide whether you intend to keep an archive and make sure your permissions cover that use as well as the live transmission. After the stream, review the recording for material that should not remain available. Removing or editing an archive does not undo an interruption that already happened during the live stream.

How audience and material affect the decision

Which parts of a lecture should you check before going live?
Make an inventory of material that was not created for the class by the teacher or school. This is a practical rights check, not a claim that every example below is automatically infringing:
- Music in an introduction, background track, or video played during class.
- Film, television, online-video, or recorded-broadcast clips.
- Photographs, diagrams, illustrations, and slides obtained from elsewhere.
- Scanned textbook pages or substantial extracts from books and other publications.
- Recordings or presentations that include other people’s performances or material.
For each item, note who created it, what permission or licence applies, and whether that permission includes streaming and any recording you plan to keep. Prefer material made by the teacher or school, material with a suitable licence, or material for which the rights holder has given permission for the intended use. YouTube identifies permission and Creative Commons licensing as possible routes for using other people’s content, but neither is a guarantee that an automated platform claim or interruption will not occur.

A practical pre-stream checklist
- Inventory the lesson. Review the slides, audio, clips, and any screen-shared material for third-party content.
- Confirm the basis for each use. Use your own material, obtain permission or a suitable licence, or assess whether a specific statutory exception applies. Do not treat “for education” as a complete rights check.
- Check the audience and format. Decide whether the stream is limited to a qualifying institutional audience or open to the public. Check the actual access and distribution plan against the relevant statutory conditions.
- Confirm live and archive permissions separately. Ask whether the licence covers YouTube, the relevant territories, livestreaming, on-demand access, and the period you intend to keep the recording.
- Ask about allowlisting when licensed content is essential. YouTube advises licensed streamers to ask the rights owner to allowlist the channel where applicable.
- Choose an archive policy before broadcasting. If you plan to save the stream, include that use in the rights check and review the finished recording afterward.
- Keep useful records. Retain licences, written permissions, and notes on what material was used and how the class was distributed.
What should you do if YouTube makes a claim or removes material?
First identify which process you are dealing with. A live interruption, a Content ID claim on an archived stream, and a formal copyright removal request are not the same event. A Content ID claim or live interruption does not decide whether an Indian statutory exception applies.
If you receive a claim, review the notice and the material it identifies, then use the available YouTube claim procedures if you believe the match or claim is mistaken. If a formal removal request is judged valid, YouTube says the material is removed and the channel receives a strike. Depending on the circumstances, a creator who believes the removal was mistaken or that an exception applies may seek a retraction from the claimant or submit a counter notification. A counter notification is a formal step, not a substitute for assessing the legal and practical risks of the specific case.

Does YouTube’s fair-use guidance answer the question for India?
No. YouTube’s fair-use guidance describes US law and notes that copyright rules differ by country. It also says Content ID cannot determine fair use because that assessment is subjective and case-specific; legal questions are for courts. An Indian school or coaching provider should assess the relevant Indian law rather than treating US fair-use guidance as a substitute. A platform’s automated decision is likewise not a judicial finding about whether a particular Indian exception applies.
