Willie Nelson’s Arrests and Legal Troubles: A Brief History

Willie Nelson's legal history covers a major IRS tax dispute and several marijuana cases from 1994 to 2010. Here is what each case reportedly produced and where the record is still unclear.

Willie Nelson’s legal record has two strands. The first is a long-running federal tax dispute with the IRS over tax-shelter investments, which led to asset seizures in 1990 and a settlement in the mid-1990s. The second is a series of marijuana-related arrests and citations in Texas and Louisiana between 1994 and 2010. Of those criminal matters, only the 2006 Louisiana case is reported to have ended in a guilty plea. The 1994 Texas case was reportedly thrown out, and the 2010 Texas case has no verified final outcome in the most recent reporting this account can confirm. Arrests, citations, charges and convictions are different steps, and this article keeps them separate.

The IRS dispute: tax shelters, seizures and a settlement

The most significant legal matter in Nelson’s career was a civil tax dispute, not a criminal case. The Internal Revenue Service disallowed tax-shelter investments Nelson had made, and the resulting claim grew with back taxes, interest and penalties.

The size of the claim

Los Angeles Times reporting from the early 1990s put the IRS claim at $16.7 million, including back taxes, interest and penalties. The figure was the agency’s demand, not a finding by a court that the full amount was owed in that form.

The seizure of November 9, 1990

HISTORY’s retrospective account dates the seizure of Nelson’s assets to November 9, 1990, and attributes the debt to investments in a tax shelter that the IRS later disallowed. Contemporary Los Angeles Times coverage described the agency taking much of his property that fall.

Nelson responded with a lawsuit seeking $45 million from Price Waterhouse, alleging that the accounting firm’s handling of his tax shelters contributed to the problem. The firm denied that it had acted as his financial adviser. The suit is an allegation reported in the press, and this account does not present its outcome as established.

The settlement figure and why sources differ

The settlement is where reported numbers diverge. HISTORY describes an agreement for a $6 million cash payment and notes that Nelson had difficulty paying even that amount. Biography.com also reports a reduced $6 million settlement. A Washington Post profile from 1995 gives a figure of around $9 million.

These are not necessarily contradictory. They describe different reports, and possibly different stages of negotiation, so the most defensible statement is that the reported settlement was about $6 million, with a 1995 Washington Post account citing roughly $9 million. Readers should treat any single number as attributed to a specific outlet and year.

The Tapes and the debt

Nelson released The IRS Tapes: Who’ll Buy My Memories? in 1991, and its proceeds were connected to the effort to repay the debt. Reporting does not support the idea that the album alone cleared the liability.

The 1994 Texas marijuana arrest

UPI reported that Nelson was arrested in May 1994 in Texas on a marijuana possession charge. Biography.com says the case was eventually thrown out. Because the underlying court record is not part of the reporting available here, the dismissal is described as reported by that biographical source. There is no reported conviction in this case, and the fine and sentence are not stated in the sources.

The 2006 Louisiana tour-bus case

On September 18, 2006, Louisiana authorities searched Nelson’s tour bus and found marijuana and hallucinogenic mushrooms. Nelson and four other people were cited. The initial citations were misdemeanor charges, and the citation itself is not evidence of a conviction.

The plea and the sentence

In April 2007, Nelson and tour manager David Anderson each pleaded guilty to a misdemeanor marijuana-possession count, as reported by the Associated Press through CBS News. Each was fined $1,024 and placed on six months’ probation.

Charges that were dismissed

The citation against Nelson’s sister, Bobbie, was dismissed, and the citations against the two drivers were also dismissed. This was the only one of the four Texas-era marijuana matters with a reported guilty plea.

The 2010 Texas arrest and its open status

On November 26, 2010, Nelson was arrested after marijuana was found aboard his bus at a checkpoint in Sierra Blanca, in Hudspeth County, Texas, according to CBS/AP reporting. He was released on a $2,500 bond.

KVIA reported in March 2014 that the Hudspeth County case was still unresolved. The same report described a decision to pursue a misdemeanor paraphernalia charge. The most recent report this account can verify is from 2014, so the final disposition of the case is not established. Readers should not assume the case ended in a conviction, a dismissal or a plea without a later official record.
