Harvey said she had not been convicted or imprisoned. Her dispute with Netflix is a civil lawsuit over the series’ portrayal, not a criminal prosecution of her.
Why didn’t the real Martha from Baby Reindeer go to prison?
Because the imprisonment shown in the series is a fictional plot event. It does not establish that Harvey was convicted or served time in real life. Harvey publicly denied having a criminal conviction or having gone to prison, according to the BBC’s report on her May 2024 interview.
That account should be attributed to Harvey: the sources cited here do not include a comprehensive official criminal-record check independently establishing her history. The show’s plot and a person’s real-world criminal record are separate things.
What did Harvey allege about the series?
In a complaint filed against Netflix, Harvey alleged that the series portrayed her as a twice-convicted stalker who had been sentenced to prison, along with other conduct she said was false. Those statements are allegations in a lawsuit, not facts established simply because they appear in the complaint. The complaint sought at least $170 million in damages; that was Harvey’s demand, not an award.

What did the court decide?
On September 27, 2024, U.S. District Judge Gary Klausner ruled on Netflix’s anti-SLAPP motion in the civil case. The order allowed Harvey’s defamation and intentional-infliction-of-emotional-distress claims to continue and dismissed other claims. It was a procedural ruling on which claims could go forward—not a trial verdict, a finding that every allegation was true, or a criminal judgment against Harvey. The court’s order explains the ruling.
What is the latest reported status of the appeal?
A report dated October 7, 2026, said the Ninth Circuit questioned whether it had jurisdiction over Netflix’s appeal and required Netflix to respond or voluntarily dismiss it. That report describes a procedural development, not a final appellate ruling or a final decision on the underlying claims. The reported appeal status therefore does not change the distinction between the series’ fictional prison plot and Harvey’s stated real-life account.

Why the civil case does not mean a prison sentence
Harvey sued Netflix in civil court; she was not being prosecuted in that case. A civil lawsuit can address claims such as defamation and may result in civil remedies if a plaintiff proves a case. It is not a criminal prosecution of Harvey and cannot turn the series’ fictional sentence into a real one.
