Jesic said he needed time to review the case records and allow incoming Los Angeles County District Attorney Nathan Hochman to consider the matter. January 30 was not the final hearing date: later court and DA notices scheduled further hearings in March, April, and May 2025.
Why was the hearing postponed?
Judge Jesic said he was not ready to proceed because he needed more time to review the case materials and give incoming DA Nathan Hochman an opportunity to weigh in. The Associated Press reported that Jesic referred to 17 boxes of documents and that technical problems prevented the brothers from appearing virtually from prison. As AP quoted him on November 25, 2024: “I’m not ready to go forward.”
The postponement moved the hearing from December 11, 2024, to January 30, 2025; it was a scheduling decision, not a ruling on whether the brothers should be resentenced or released. The Associated Press reported the postponement and Jesic’s stated reasons.
What was the DA’s recommendation, and what could the judge decide?
On October 24, 2024, then-DA George Gascón announced that his office would recommend resentencing Erik and Lyle Menendez. The brothers had been convicted of first-degree murder in 1996, following trials in 1993 and 1995, and sentenced to life without parole for the 1989 killings of Jose and Kitty Menendez, according to the county’s announcement.

The recommendation did not change their sentences. The Los Angeles County release said a Superior Court judge would decide whether to formally resentence them and whether they would be released. The DA’s office said its recommendation followed a review of defense materials, meetings with family members, and consideration of the brothers’ conduct in prison. How did the hearing schedule change after January?
January 30 was an announced reset date, not a final date. Subsequent official releases and court notices listed additional hearing dates:

These notices establish the dates that were scheduled; they do not, on their own, establish what the court ultimately decided.

The DA’s resentencing recommendation and the brothers’ habeas petition are separate legal tracks. The county said the judge would make the final decision on the resentencing request. It also noted that the habeas petition remained a possible route if the court declined the DA’s recommendation. A prosecutor’s position, a scheduled hearing, and a court ruling are not interchangeable.

What the postponement did—and did not—mean
- It delayed the hearing then scheduled for December 11, 2024, to January 30, 2025.
- It did not itself grant resentencing or release the brothers.
- It did not make January 30 the final hearing date; later notices listed dates in March, April, and May 2025.
