Miley Cyrus is being sued over “Flowers” by Tempo Music Investments, which alleges the 2023 song infringes its claimed share of the copyright in Bruno Mars’s 2013 song “When I Was Your Man.” Bruno Mars is not the plaintiff in the case, and the court has not found that Cyrus copied the song. The latest located docket summary says key motions were still awaiting decisions as of August 24, 2026.
Who filed the lawsuit—and what does it claim?
Tempo Music Investments, LLC filed Tempo Music Investments, LLC v. Miley Cyrus et al. in the U.S. District Court for the Central District of California on September 16, 2024. The case is numbered 2:24-cv-07910. Tempo claims it owns a share of the copyright in “When I Was Your Man” through songwriter Philip Lawrence’s catalog. That is Tempo’s asserted rights chain; it does not mean Bruno Mars filed the lawsuit.
According to the complaint, Bruno Mars, Philip Lawrence, Ari Levine, and Andrew Wyatt co-wrote “When I Was Your Man.” The complaint identifies Miley Cyrus, Gregory Hein, and Michael Pollack as co-writers of “Flowers.” Tempo alleges that “Flowers” uses protectable material from the earlier song, pointing to alleged similarities in melody, lyrics, and other musical elements. Did Miley Cyrus copy Bruno Mars?
The lawsuit accuses Cyrus and others of infringement, but the accusation is not proof that copying occurred. Whether the songs share legally protectable material and whether Tempo can establish infringement are questions the court has not resolved in the procedural decisions described below. It is therefore more accurate to say that Tempo alleges copying than to state that Cyrus stole or plagiarized the song.

What has the court decided?
The March 2025 ruling addressed whether Tempo could proceed
On March 18, 2025, the court denied the defendants’ motion to dismiss, which argued that Tempo could not bring its infringement claims without joining other co-owners. The ruling allowed Tempo to pursue the case at that stage. It did not decide whether “Flowers” infringes the copyright or establish that Cyrus copied “When I Was Your Man.” Read the court’s order.
Later motions were awaiting decisions in the latest located update
A docket summary updated August 24, 2026 reports that the parties argued summary-judgment and expert-evidence motions on May 26, 2026. The motions were taken under submission, and trial dates were vacated while the court considered them. That summary does not establish whether the court has issued a later ruling.
