What was reported about the 2004 arrest?
An Associated Press report published by the Los Angeles Times said Lane called police during an argument at the couple’s home. Brolin was arrested around 3 a.m. on December 19, 2004, on suspicion of misdemeanor domestic battery, according to the report. He was released on $20,000 bail. Was Brolin charged?
Not at the point described in the contemporaneous report. Frank Mateljan, a spokesman for the Los Angeles city attorney’s office, said the office was reviewing the case and that no charges had been filed. A later E! News account says the case was dropped, but the sources cited here do not establish the exact date or provide a court record confirming the disposition. Brolin should not be described as convicted in connection with the 2004 allegation.
What did the couple’s spokesperson say?
Kelly Bush, the couple’s spokeswoman, characterized the incident as a “misunderstanding” and said Brolin and Lane had reconciled, the Los Angeles Times reported. That was the spokesperson’s account at the time, not a legal finding or an independently established explanation of what happened.

Why was Brolin careful talking about it in 2018?
In a 2018 New York Times profile, Brolin said he had “never been so careful with my words” because “there’s no explaining it.” He added: “The only person who can explain that would be Diane, and she’s chosen not to, so I’m O.K. with that.” The profile notes Lane did not comment; her silence does not establish her view of the incident. Brolin also described an earlier impulse to insist that people know “the truth,” but said he worried that anything he said would “sound like compensation for a perpetrator.” He told the interviewer he had reached a point where what mattered was having control over his own behavior, contrasting that with a time he called “a little more chaotic.” His remarks explain his reluctance to offer a public account; they do not resolve the underlying allegation.

Brolin was reported arrested in other incidents, but they were separate events and should not be used to infer what happened in 2004.
