What Rob Reiner Did for Marriage Equality—and What His Record Shows on Taxing the Rich

Rob Reiner’s marriage-equality work centered on AFER’s challenge to Proposition 8 and the stage reading 8. His documented tax advocacy was for a separate tobacco-tax initiative, not California’s 2012 campaign to tax higher earners.

Rob Reiner’s documented marriage-equality work centered on the federal challenge to California’s Proposition 8: he served on the founding board of the American Foundation for Equal Rights (AFER) and directed 8, a stage reading based on the trial. The evidence does not establish that he led California’s 2012 “tax the rich” campaign. His separate tax-related advocacy was for Proposition 10, a tobacco tax that funded early-childhood programs.

What did Rob Reiner do for marriage equality?

Reiner’s documented role was as an organizer and public advocate associated with AFER, the organization that brought a federal constitutional challenge to Proposition 8. CBS News reports that Reiner and his wife were among AFER’s founding board members. AFER’s own 2012 release identifies him as a founding board member and as the director of 8, a staged account of the case.

Those roles place Reiner within the legal and public-facing effort against Proposition 8. They do not show how much his individual advocacy changed public opinion or affected the court’s decision. The litigation was one part of a broader movement, and the available evidence does not support assigning its outcome—or marriage equality nationally—to one advocate.

How did Proposition 8 become a federal case?

  • June 16, 2008: Same-sex marriage became legal in California following the state Supreme Court’s decision in In re Marriage Cases.
  • November 4, 2008: California voters approved Proposition 8, which amended the state constitution to prohibit same-sex marriage.
  • January 2010: AFER’s federal challenge, Perry v. Schwarzenegger, went to trial. AFER’s trial materials list four plaintiffs and expert witnesses from fields including history, psychology, economics, and political science.
  • August 4, 2010: A federal district judge ruled Proposition 8 unconstitutional under the Fourteenth Amendment’s Due Process and Equal Protection Clauses.

The sequence matters: Proposition 8 reversed the state’s newly established marriage-equality policy, and the federal case challenged that ban. The American Psychological Association’s case summary provides the legal timeline. California’s official voter guide includes arguments from both sides, but it warns that ballot arguments are campaign statements, not claims verified for accuracy by a state agency.

What was Reiner’s role in the play 8?

In March 2012, AFER and Broadway Impact presented 8, written by Dustin Lance Black and directed by Reiner. The play drew on the federal trial and was presented as a fundraiser for marriage equality. It gave the case a public-facing cultural form in addition to its courtroom setting; directing it is distinct from serving as a lawyer or deciding the case.

Did Reiner help lead the campaign to tax the rich?

The available record does not establish that Reiner led or participated in California’s 2012 Proposition 30 campaign. That measure followed a “Millionaires Tax” effort by a labor-community coalition that negotiated with Governor Jerry Brown. The resulting ballot measure combined temporary income-tax increases on higher earners with a sales-tax increase, with revenue sought for public services during a state budget crisis.

This account of the campaign comes from California DSA, an advocacy organization, so its description should be read as that organization’s history of the effort rather than as a neutral government account. It describes a separate political campaign from Reiner’s work against Proposition 8; the evidence here does not connect him to the Proposition 30 coalition.

What tax advocacy is documented for Reiner?

CBS News reports that Reiner chaired the campaign for California Proposition 10 from 1999 to 2006. Proposition 10 used a tobacco tax to fund early-childhood programs. That is a documented tax-related advocacy role, but it was not a campaign to tax high earners.

The two tax measures therefore should not be conflated: Proposition 10 was the children’s-program initiative associated with Reiner, while Proposition 30 was the later measure that raised income-tax rates on higher earners as part of a broader revenue package. The available sources do not establish Reiner’s role in the latter.

What can—and can’t—be attributed to Reiner?

  • Documented: AFER founding-board service, participation in the public advocacy surrounding its Proposition 8 challenge, and direction of 8.
  • Not established: The amount his advocacy changed public opinion, its individual effect on the litigation’s outcome, or a leadership role in Proposition 30.
  • A separate tax record: Chairing the Proposition 10 campaign, which supported a tobacco tax funding early-childhood programs.

So the title’s two causes require different answers: Reiner’s connection to the marriage-equality fight is documented through AFER and 8; the evidence does not support describing him as a leader of the 2012 “tax the rich” effort.
