Marriage is a legally recognized relationship or status. What it actually does for a couple, including who qualifies, how it is formed, and what follows from it, is set by the law of the jurisdiction concerned. In many places that law treats the partners as spouses and can affect inheritance, taxes, and parental responsibilities. There is no single worldwide definition or checklist. Religious or cultural meaning matters to many couples, but by itself it does not decide whether a government recognizes a marriage.
What marriage means in law
In plain terms, marriage gives two people a status that the law recognizes, and that status can trigger rights, responsibilities, and procedures. It is not a single contract with identical terms everywhere. The United Nations Statistics Division, in its vital statistics guidance (Principles and Recommendations for a Vital Statistics System, Revision 2), explains that marriage and divorce are defined through law and custom rather than by a universal biological event, and that these definitions vary among countries and areas. That is the reason international comparisons of marriage need care: two couples who describe themselves as married may hold very different legal positions.
What marriage can change in practice
The clearest official example comes from GOV.UK, the UK government’s guidance, which describes the legal effects of marriage and civil partnership in England and Wales (page accessed October 8, 2026). According to that guidance, marriage or civil partnership can mean:
- legally becoming a spouse or civil partner;
- eligibility for certain tax benefits;
- parental rights and responsibilities when the couple has children together;
- inheritance rights if a spouse dies without a will.
These effects describe England and Wales. They are not a list that applies to every country, state, or province, and they should not be read as a global guarantee.

Living together is not automatically marriage
A common assumption is that a set period of living together creates a marriage. In most of the sources reviewed, it does not. The UK government states plainly: “‘Common law marriages’ do not exist in England and Wales, even if you’ve lived together for a long time or have children.” Cohabiting couples there do not acquire spousal status simply through the length of the relationship or through having children together.
The phrase “common-law marriage” is used in some other places, but the conditions are jurisdiction-specific. The U.S. Department of State, in its family-based relationships guidance (9 FAM 102.8, text marked June 26, 2025), recognizes a common-law marriage for the adjudications it covers only where the place it arose treats the union as fully equivalent to a formal marriage. The criteria it lists include:
- a relationship that can end only by divorce or death;
- potential alimony;
- intestate inheritance (inheritance when there is no will);
- custody rights where children are involved.
These are State Department criteria for its own adjudications. They do not establish a test that every jurisdiction applies.
How marriages are recognized across borders
U.S. federal law
Under 1 U.S.C. § 7, as shown in the current official edition published by the Office of the Law Revision Counsel, the statute provides that for any federal law, rule, or regulation in which marital status is a factor, an individual is considered married if the marriage is between two individuals and is valid in the State where it was entered into. The statute also addresses marriages entered outside a U.S. state, setting conditions tied to validity where the marriage was entered into and to whether it could have been entered into in a state. Because the quoted clause is only part of the provision, read the full text before relying on it, and check whether courts or later legislation have affected how a provision applies to your question.
U.S. visa adjudication
The State Department’s marriage guidance (8 FAM 304.1, text marked March 2, 2023) says that for visa adjudication, the law of the place of celebration generally controls, subject to exceptions. It also requires that any prior marriage be legally terminated before a later marriage can be recognized. Its treatment of common-law marriages and civil unions is tied to recognition and legal equivalence in the place concerned. These are administrative rules for specified U.S. purposes, not universal international law.

What these sources do not establish
The sources reviewed do not supply a current worldwide legal survey, so this article cannot tell you the age, consent, licensing, ceremony, registration, property, immigration, or divorce rules for a given country. Those rules often differ by country and, in federal systems, by state, province, or territory. The UN guidance explains why marriage data are hard to compare; it is not a source for a current global marriage rate or trend, and this article does not offer one. For a decision that affects your property, children, or immigration status, consult a lawyer or official authority in the relevant jurisdiction.
