Kevin Costner is being sued by stunt performer Devyn LaBella over an alleged unscripted simulated rape scene filmed during production of Horizon: An American Saga – Chapter 2. LaBella says the scene was sprung on her without advance notice or the safeguards used for a planned scene the previous day. Costner’s lawyer denies the claims have merit. The allegations have not been established as facts by a court.
What is Kevin Costner being sued for?
LaBella filed a civil lawsuit in Los Angeles County Superior Court on May 27, 2025, against Costner and production entities associated with Horizon: An American Saga – Chapter 2, according to the Associated Press. The case concerns events she says took place on the film’s set in 2023. The defendants’ later court filing identified the case as No. 25STCV15235 and said an amended complaint was filed on June 27, 2025.
LaBella seeks damages. Her complaint also asks for harassment training, intimacy-coordinator requirements on future productions, and a public apology. These are remedies she requested; the cited reports do not establish that a court granted them.
What does the stunt performer say happened on the Horizon set?
LaBella, a stunt performer who worked as a double for actress Ella Hunt, distinguishes between two scenes on consecutive days. Her account, as described in the complaint and reported by the Associated Press, is that the first was planned and prepared for, while the second was unexpected and lacked comparable safeguards.

The planned scene on May 1, 2023
LaBella alleges that a simulated sexual-assault scene filmed on May 1 was planned, with preparation that included an intimacy coordinator.
The alleged unscripted scene on May 2
LaBella says that on May 2 she was directed into another simulated rape scene without advance notice, rehearsal, choreography, or an intimacy coordinator. The Associated Press reported that the complaint alleges Costner directed an actor to pin her down on a wagon and simulate rape. These are LaBella’s allegations, not findings that the events occurred as she describes them.

How has Costner responded?
Costner’s lawyer, Martin Singer, said the lawsuit had “absolutely no merit.” Singer also said LaBella’s assertions were contradicted by her behavior and the facts. That is the defense’s position; it does not by itself resolve the disputed allegations.

In August 2025, the defense filed a special motion to strike under California’s anti-SLAPP law. October 2025 reporting said Judge Jon R. Takasugi denied the motion as to most claims while striking two claims. November reporting said proceedings were stayed pending appeals. This is the latest procedural posture verified in the cited reporting; developments after November 2025 were not verified as of October 8, 2026. The available information does not establish a final decision on the underlying allegations.
