Check the rejection decision immediately. The deadline to appeal depends on the type of decision and procedure, and the notice should state the deadline and filing route for your case. Contact a lawyer as soon as possible; Greece’s Ministry of Migration and Asylum says free legal assistance is available for second-instance appeals through its registry of lawyers. This is general procedural information, not a decision about an individual case.

If your asylum claim got rejected, what happens now depends first on whether this is a first-instance decision or a rejection by the Appeals Authority. A first-instance refusal can generally be appealed. A timely appeal usually permits the applicant to remain while it is pending, but exceptions apply and an appeal does not always stop removal.

First, identify which decision you received

Read the full decision and its notification information before deciding what to do next. It should explain why the claim was rejected, the appeal route and the time limit. Keep the decision and any evidence showing when and how it was delivered. The date and manner of notification can matter when a deadline is calculated.

There are two decisions that readers may describe simply as “a rejection,” but they lead to different next steps:

  • Read Before You Buy — No Video Output: These adapters support charging and USB 2.0 data transfer, but cannot transmit video signals. Except for standard USB webcams (which use USB data only), they are not compatible with HDMI/DisplayPort cables, video-capable USB-C hubs, or docking stations with video output.
  • Convert USB-A Ports to USB-C: Designed to connect USB-C earphones, cables, flash drives, card readers, and other USB-C accessories to standard USB-A ports. Plug-and-play with no drivers or software required.
  • Aluminum Alloy Housing: Built with a sturdy aluminum alloy shell that aids in heat dissipation and protects against daily wear and scratches. Designed to maintain a stable and secure connection.
  • Compact & Travel-Friendly: The ultra-compact design allows the adapter to stay plugged into your device without blocking adjacent ports or adding bulk, reducing wear and tear on your original USB ports.
  • 12-Month Warranty: Backed by a 12-month manufacturer warranty for peace of mind. Designed to meet strict quality control standards for reliable everyday performance.
  • A first-instance decision: The Asylum Service has rejected the application, or granted subsidiary protection when the applicant believes the facts justify refugee status. The Ministry says either decision may be appealed before the Appeals Authority.
  • An appeal decision: An Independent Appeals Committee has rejected the second-instance appeal. A court application for annulment may be available, but it has a different deadline and does not by itself automatically grant permission to remain.

Check whether the decision also contains a return decision. The Ministry’s current procedure says a return decision must be challenged together with the relevant appeal or annulment application. Do not assume that contesting only the asylum refusal addresses every part of the decision.

Appealing a first-instance rejection

A first-instance rejection is generally appealable to the Appeals Authority. The Ministry also says a person granted subsidiary protection may appeal if they believe they qualify for refugee status instead. The appeal is a written filing examined by an Independent Appeals Committee; it is not simply a request to the original caseworker to reconsider the refusal.

There is no single safe deadline for every case

Do not rely on a general online statement that every appeal must be filed within a particular number of days. The applicable period depends on the decision type and procedure. The Ministry’s current Appeals Authority procedure points to Article 135(2) of Law 5307/2026. A text of that article hosted by a legal publisher lists ten-day and thirty-day categories, but the Ministry’s English summary does not reproduce the complete category list.

Decision or route Timing stated in the current materials What to do
Specified inadmissibility decisions, implicit withdrawal, and certain accelerated or manifestly unfounded cases at first instance Ten days for the categories specified in Article 135(2) of Law 5307/2026, as set out in a legal-publisher text of the article Check the exact category and deadline in the decision. Do not assume that every inadmissibility or accelerated case has the same facts or deadline.
Other specified first-instance appeal categories Thirty days for the other categories specified in Article 135(2), according to that legal-publisher text Use the notice in your own decision and get prompt advice about how the period is counted.
Annulment application after an Appeals Committee rejection Thirty days, counted from the day after notification, according to the Ministry’s 2026 procedure page Ask a lawyer immediately about the filing, the return decision and any separate request to suspend removal.
Appeal against an inadmissibility decision on a subsequent application Five days under the Ministry’s subsequent-application guidance Seek urgent advice; this is a distinct procedure, not the ordinary first appeal.

The Ministry’s page confirms that Article 135(2) governs first-instance appeal periods. The detailed ten- and thirty-day categories above come from a legal-publisher text rather than an opened official Gazette document. The Ministry listed Law 5307/2026 in Gazette A 90, dated 11 June 2026. Because the decision type, procedure and notification circumstances matter, the decision itself and advice on your case should guide the deadline calculation.

Check the deadline written on your decision now. Different rejection procedures have different appeal periods. Contact a lawyer or apply for the Ministry’s free legal-assistance route immediately; do not wait to resolve every question before asking for help.

Where and how to lodge the appeal

The Ministry describes the second-instance appeal as a written filing signed by the applicant or by a lawyer authorised to act for them. Its current procedure says to lodge it in person at the Regional Asylum Office or Autonomous Asylum Unit that issued the decision, or at the competent office for the applicant’s residence. Follow the filing office stated in the notice and confirm the correct route with the competent office if your circumstances are unusual.

The Ministry’s public rejection guidance describes a practical route for some people living in accommodation far from the office that issued the decision: filing may be possible at the nearest Asylum Service office. Detained applicants have a different route: facility staff must transmit the appeal to the issuing office on the same day. These arrangements are not interchangeable, so a person should not assume that an office convenient to them will accept a filing in every situation.

Keep proof that the appeal was lodged, along with a copy of the signed document and any accompanying material. If a return decision is part of the first-instance decision, the current procedure says it must be challenged together with the appeal. Ask which office is competent if the notice and your current residence appear to point to different places; do not wait until the final day to resolve a filing-location question.

Ask promptly about free legal assistance

The Ministry says the Asylum Service keeps a registry of lawyers who can provide free assistance with lodging and examining a second-instance appeal, and that applicants may apply online. This is a route to request help, not a guarantee that a lawyer has already been assigned or will be immediately available. Since deadlines can be short, apply promptly and do not treat the application for assistance as a substitute for checking the appeal deadline and filing requirements.

When requesting help, have the decision and notification details available so that the urgency and applicable procedure can be assessed. If you already have a lawyer, clarify who is responsible for lodging the signed appeal and for monitoring later notices. The Ministry’s free route concerns second-instance appeal assistance; the public guidance says a later annulment application requires a lawyer and is at the applicant’s expense.

What to expect while the appeal is examined

The appeal is examined by an Independent Appeals Committee. Depending on the case, the process may include an oral hearing, written observations and additional evidence. Read any hearing notice carefully: it should explain the arrangements and be provided in a language the appellant understands.

Attendance and accepted certificates

The Ministry’s current procedure says the appellant must appear in person or through an authorised lawyer, or ensure that an accepted certificate is sent. If the appellant does not attend and no accepted certificate is provided, the appeal can be treated as implicitly withdrawn and rejected as unsupported unless force majeure is established. Do not assume that missing a hearing will be excused automatically. Follow the notice, and confirm with counsel what attendance or certificate arrangement applies to your case.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

This attendance requirement is separate from the question of whether the appeal was filed on time. A person should track both the original filing deadline and any later hearing instructions. If illness or another serious obstacle affects attendance, contact counsel and the competent authority as soon as possible to ask what documentation or procedure is accepted; do not assume an explanation submitted later will automatically prevent an implicit-withdrawal outcome.

Hearings, observations and new evidence

The Committee must hold an oral hearing in specified circumstances, including where significant new evidence has arisen after the first-instance examination or there are doubts about whether the first interview was complete. Not every appeal necessarily follows the same hearing path.

The Ministry says hearing notice is generally given at least ten days before the hearing, and at least two days in border or accelerated cases. Written observations and supporting evidence may generally be filed up to three days before the hearing, subject to the border-procedure exception. These are procedural timings; check the notice and seek advice about the schedule that applies to your case.

Organise evidence so the Committee can see what it is and why it matters. For example, explain whether a document is new, what facts it supports, and why it was not considered at first instance. Do not wait until the last possible day to ask how to submit it, particularly if the notice sets a different or more specific instruction. Keep copies of what you send and any confirmation of receipt.

Can you remain in Greece while a first appeal is pending?

The Ministry’s current procedure says an applicant is permitted to remain during the period for lodging an appeal and, if an appeal is lodged on time, until notification of the appeal decision. The Ministry expressly qualifies this rule by reference to exceptions in Greek and European Union law, including Article 68 of Regulation (EU) 2024/1348. Its statement is therefore not a guarantee that every appeal prevents removal.

If an appeal does not have automatic suspensive effect, the applicant may ask the Appeals Committee for permission to remain. The Ministry says that request must be filed within ten days after notification of the negative decision. Ask a lawyer urgently whether this route applies; do not assume the ordinary appeal alone pauses return action.

A further qualification applies to some subsequent applications: an exception may arise where an appeal is considered to have been lodged solely to delay or prevent return. The rules depend on the facts and procedure, so a person facing removal should get case-specific advice rather than infer a right to remain from the fact that a filing was made.

In practical terms, distinguish three things: the time allowed to lodge an appeal, whether the appeal has automatic suspensive effect, and whether a separate request for permission to remain or suspension is needed. These are related but not interchangeable. If the decision or a notice refers to return, removal or a lack of suspensive effect, raise that issue with a lawyer immediately rather than assuming it will be resolved by the appeal itself.

If the Appeals Committee rejects the appeal

The Ministry says an Appeals Committee rejection includes a return decision. An application for annulment may be filed before the Administrative Courts of First Instance of Athens or Thessaloniki within thirty days, counted from the day after notification of the Committee’s decision. The return decision must be challenged together with the annulment application.

This is a court procedure, not another administrative appeal. The Ministry’s public guidance says the application requires a lawyer and is at the applicant’s expense. Most importantly, filing an annulment application does not automatically create a right to remain. The Ministry warns that removal may be possible if a suspension application is not granted. Get urgent individual legal advice about the return decision, removal risk and whether a separate request to suspend removal is available. Do not infer that filing the court application alone stops enforcement.

For this stage, the deadline is counted from the day after notification, rather than being described as a universal number of days after the first asylum refusal. Preserve the Appeals Committee decision and proof of its notification, and ask counsel to address both the asylum outcome and the return decision in the court filing. The possibility of an annulment application is not a promise that the court will annul the decision or grant suspension.

When a subsequent application is a separate option

A subsequent application is not simply a second ordinary appeal of the same rejection. The Ministry describes it as a procedure following a final rejection or withdrawal and requiring new reasons or evidence. The Asylum Service first assesses whether the application is admissible and whether the material is sufficiently new and substantial.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Ministry says no applicant card is issued at the moment a subsequent application is filed. If the Asylum Service decides that it is inadmissible, the Ministry’s guidance gives a five-day appeal period. The MITOS registry states that return measures are suspended during that appeal window and until notification of the decision on that appeal. Rules for repeated subsequent applications and remaining in Greece are conditional; a subsequent application should not be treated as an automatic extension of the first appeal or as a guaranteed bar to return.

Before pursuing this route, discuss with a lawyer what is genuinely new, why it matters to the protection claim, and whether the material can be documented. The procedure first tests admissibility; filing alone does not mean the application has been accepted for full examination. The five-day period mentioned here is specifically for appealing an inadmissibility decision on a subsequent application, not a deadline to use for an ordinary first-instance appeal.

How the three routes differ

The routes are not substitutes for one another. The right next step depends on where the case stands and what decision was served:

Route When it applies and who decides Main filing and timing Effect on remaining
Second-instance administrative appeal After a first-instance rejection, or a subsidiary-protection grant challenged as insufficient; examined by an Independent Appeals Committee. Signed written appeal through the designated Regional Asylum Office or Autonomous Asylum Unit. The period is decision-specific; current categories include ten- and thirty-day periods. A timely appeal generally permits remaining until the appeal decision is notified, subject to legal exceptions. Some cases require a separate request for permission to remain.
Annulment application After the Independent Appeals Committee rejects the appeal; brought before the Administrative Courts of First Instance of Athens or Thessaloniki. Filed with a lawyer within thirty days counted from the day after notification; the return decision must be challenged as well. Filing does not itself automatically provide a right to remain. A separate suspension request may be relevant.
Subsequent application After final rejection or withdrawal where there are new reasons or evidence; the Asylum Service first considers admissibility. New material must support the request. An inadmissibility decision may be appealed within five days under Ministry guidance. Filing does not guarantee an applicant card or a right to remain in every situation; the consequences depend on the decision and procedure.

This comparison is only an orientation aid. It does not establish which route is available in an individual case, and it does not replace the deadline and instructions in the actual decision.

Practical next steps

  1. Secure the decision. Keep the complete notice and record when and how it was notified.
  2. Locate the deadline and filing instructions. Read the relevant parts of the decision and identify whether it is a first-instance refusal, a subsidiary-protection decision, an Appeals Committee rejection or a decision on a subsequent application.
  3. Seek legal help immediately. Contact a lawyer or apply through the Ministry’s free second-instance legal-assistance route. Do not wait for an appointment before checking what must be filed and when.
  4. Use the applicable filing route. Follow the office and procedure specified for your situation, and retain proof of submission.
  5. Track notices and hearing requirements. Keep contact details current, follow card-renewal instructions, and confirm whether you must attend personally, appear through an authorised lawyer or provide an accepted certificate.
  6. Prepare relevant evidence on time. Follow the Committee’s schedule for observations and supporting material, including any case-specific instructions in the hearing notice.
  7. If the appeal is rejected, act urgently. Ask counsel about the thirty-day annulment period, the return decision and whether a separate suspension request is available.
  8. Consider a subsequent application only as its own procedure. Discuss the new reasons or evidence and the consequences for remaining in Greece with a lawyer.

The Greek Ministry of Migration and Asylum’s current Appeals Authority procedure is the main source for the appeal, attendance, hearing and stay rules described here. Its public rejection guidance and subsequent-application guidance provide additional plain-language procedural information. The MITOS registry entry for subsequent applications was last updated on 2 September 2026. Procedures and individual deadlines can depend on the decision and notification circumstances; the notice and qualified legal advice are essential for an individual case.

Frequently Asked Questions

My asylum claim got rejected in Greece. What should I do first?

Check the decision immediately for its appeal deadline, filing office and instructions. Keep the decision and proof of when and how it was notified, then contact a lawyer or apply promptly for the Ministry’s free legal assistance for second-instance appeals. Do not wait for a general online deadline to determine what applies to your case.

How long do I have to appeal a first asylum rejection in Greece?

There is no single period for every case. Article 135(2) of Law 5307/2026 includes ten-day and thirty-day categories for specified decisions. The exact type of decision and procedure matter, so check the deadline stated in your notice and get prompt legal advice.

Can I stay in Greece while my appeal is pending?

The Ministry says an applicant may generally remain during the appeal deadline and, if the appeal was filed on time, until the appeal decision is notified. Exceptions apply. If the appeal has no automatic suspensive effect, the Ministry says a request for permission to remain must be filed within ten days after notification of the negative decision.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What happens if the Appeals Committee rejects my appeal?

The Committee’s rejection includes a return decision, according to the Ministry. An annulment application may be filed before the Administrative Courts of First Instance of Athens or Thessaloniki within thirty days, counted from the day after notification. The return decision must also be challenged, and filing alone does not automatically give a right to remain.

Can I make another asylum application after a final rejection?

A subsequent application is a distinct procedure, not another ordinary appeal. It must be based on new reasons or evidence and is first assessed for admissibility. The Ministry says no applicant card is issued when it is filed; an inadmissibility decision may be appealed within five days. It does not automatically guarantee a right to remain.

Do I have to attend an appeal hearing?

The Ministry’s current procedure says the appellant must appear personally or through an authorised lawyer, or ensure that an accepted certificate is sent. Failure to attend without an accepted certificate can lead to the appeal being treated as implicitly withdrawn and rejected as unsupported unless force majeure is established. Follow the hearing notice and confirm the arrangement with counsel.

The Bottom Line

Bottom line: the decision notice determines the route and deadline, and different rejection procedures have different timelines. Get legal help immediately, file through the correct office, and do not assume that an appeal or later court application automatically prevents removal.
