The reports concern photographs linked to an Elle photoshoot and later published by Spanish magazine Interviú in March 2007. Those are separate events: contemporary coverage said Interviú had not been told by the agencies that Pataky was posing for a particular publication. The record therefore does not support saying she knowingly posed for Interviú or agreed to its publication.
How the photoshoot and publication were connected
In April 2007, EL PAÍS reported on the dispute and identified Elle’s May issue. A separate account by Cadena SER said agencies that offered the photographs to Interviú had not told the magazine that Pataky had posed for a particular publication.

Interviú’s statement, reproduced by Cadena SER, said: “Si Elsa Pataky estaba o no posando para alguna publicación concreta es una circunstancia desconocida por ‘Interviú’, ya que las agencias que ofrecieron el material en ningún momento hicieron referencia a este supuesto hecho”. The source does not name the person who made the statement.
The distinction matters: participating in a photoshoot for one publication is not, by itself, evidence of consent to another outlet’s publication. The contemporaneous accounts leave unclear what Interviú knew about the intended outlet when the material was offered.

What was reported about the legal case
A secondary reference account reports that Spain’s Supreme Court awarded Pataky €310,000 against Ediciones Zeta, Interviú’s publisher, in September 2012 over the March 2007 publication. It also says Zeta intended to appeal. The underlying judgment is not available in the cited reporting here, so the amount and appeal statement should be understood as secondary-source reporting, not independently verified details of the court decision.

In an October 2017 feature, ¡HOLA! quoted Pataky saying, “Me gusta ser natural, estoy a gusto con mi cuerpo y no tengo nada que esconder” (“I like being natural, I’m comfortable with my body and have nothing to hide”). The feature concerned a different lingerie photoshoot for Women’secret’s new collection. It does not establish her intentions or consent regarding the 2007 Interviú publication.
