Joseph and Summer McStay and their young sons, Gianni and Joseph Jr., disappeared from their Fallbrook, California, home in 2010. Three years later, their remains were found in shallow graves in the Mojave Desert near Victorville. Joseph McStay’s former business partner, Charles “Chase” Merritt, was convicted of the murders and sentenced to death in 2020, but he denied killing the family. The prosecution’s account of why the family was killed remains an allegation, not an independently established motive.
What happened to the McStay family?
The McStays vanished from their home in Fallbrook, a community in San Diego County, in 2010. A 2025 account says the family had moved into the house four months earlier and that their two dogs were left behind. Their white Isuzu Trooper was later found at a strip mall near the border, prompting early speculation that they might have gone to Mexico. That was a theory, not evidence of their plans or destination.
In 2013, a motorcyclist found a skull in the Mojave Desert near Victorville and contacted investigators. Authorities searching the area discovered the family’s remains in two shallow graves. The report describes Gianni as four and Joseph Jr. as three.
What did investigators say about how the family died?
The 2025 account says investigators determined that the family had been beaten to death with a sledgehammer found in one of the graves. No autopsy records are included in the sources available here, so this description should be understood as reported investigative findings rather than an independent review of forensic records.

Why did prosecutors accuse someone close to Joseph McStay?
Prosecutors charged Joseph’s former business partner, Charles “Chase” Merritt. According to the 2025 account, prosecutors argued that financial pressure, gambling and a deteriorating business relationship supplied a motive. Those are prosecution allegations; the conviction does not by itself establish every asserted detail of motive as fact.
A brief filed by amici and hosted on the California Supreme Court’s website says cellphone evidence placed Merritt at the McStay home and at the gravesite. What was the verdict, and what did Merritt say?
Merritt was convicted and sentenced to death in 2020, according to the 2025 report. At sentencing, he denied responsibility and said, “I loved Joseph,” as NBC News reported. The verdict and his denial are both central to the case: the jury convicted him, while he maintained that he did not kill the family.
The sources cited here do not establish the case’s current appellate or sentence status. The 2020 sentence should not be taken as a statement about what has happened in court since then.
