What Defendants Can Do When Media Coverage Threatens a Fair Trial

U.S. defendants can ask a court to address publicity risks through jury screening, a continuance, venue change, sequestration, instructions, or participant controls. Relief depends on the record and applicable law; stopping independent press publication raises serious First Amendment concerns.

In a U.S. criminal case, a defendant can ask the court to reduce the risk that media coverage will distort jury selection or influence jurors during trial. Possible measures include more searching jury questioning, a continuance, a change of venue, sequestration, instructions to jurors, and controls on courtroom conduct or statements by people involved in the case. None is automatic: the judge considers the record, the applicable law, and whether the requested measure addresses the particular risk. A request to stop independent news outlets from publishing raises much more serious First Amendment concerns.

What should a defendant do first?

Raise the concern promptly with defense counsel. The practical question is not simply whether a case has received attention, but whether the coverage creates a risk to impartial adjudication that the court can address. The judge needs a record concrete enough to assess the coverage and the protection requested. The cited cases do not prescribe a universal evidence checklist, and the proper motion, timing, and legal test depend on the court where the case is pending.

Preserve the coverage and identify the risk

Keep dated copies or records of relevant reporting and publicity. For each item, note the outlet, publication date, content, and—if known—its circulation or reach. Include relevant public statements by lawyers, parties, witnesses, court officials, or government employees involved in the matter. Separate reporting about the case generally from material that might bear directly on jurors’ ability to decide it impartially.

Give counsel examples rather than relying only on a general assertion that coverage is extensive or unfair. This helps connect the material to a proposed remedy: a jury pool affected by local coverage may raise a different practical concern from jurors’ exposure to ongoing reporting once trial begins. The court will evaluate the circumstances and the record; documenting coverage does not by itself establish prejudice.

Check the law and procedure in the court handling the case

There is no single state-specific or federal procedural checklist established by the authorities discussed here. Filing deadlines, motion practice, evidentiary support, local rules, and the governing legal test must be checked in the relevant court. A constitutional overview cannot determine whether a particular motion is timely or likely to succeed in a particular case.

Which remedies can the court consider?

Different remedies address different points of exposure. A venue change concerns the jury pool; a continuance gives attention time to subside; jury screening targets prospective jurors’ exposure and views; sequestration and instructions address outside information during trial. Courts may also manage courtroom conditions and consider limits on statements by people subject to their authority. These are options for the court to assess, not guaranteed entitlements.

Measure Risk it may address Key practical question
Searching voir dire Prospective jurors’ exposure to coverage or opinions already formed Can questioning identify people unable to decide the case impartially?
Continuance Intense pretrial publicity that may diminish with time Could postponement allow the threat to abate, and what are the case-specific costs of delay?
Change of venue A jury pool in a community affected by the publicity Would another community offer a realistic chance to select an impartial jury?
Sequestration Jurors’ exposure to outside coverage while trial is underway Would limiting jurors’ outside exposure address the identified risk?
Jury instructions Exposure to media or other outside information during trial What directions can the court give jurors about avoiding coverage and deciding on admitted evidence?
Courtroom or participant controls Disruption or publicity generated by conduct within the court’s authority Can a narrower measure address the conduct without restricting independent reporting?

This comparison is a practical way to frame the issue, not a court-promulgated test. The judge selects any relief on the record and under the law that applies.

How do venue changes and continuances differ?

A change of venue changes the jury pool

A venue motion asks the court to move the trial to a community less affected by the publicity. It does not erase coverage or guarantee that the new pool will be impartial. The relevant question is whether an impartial jury can be selected in the proposed setting, considering the actual reach and character of the reporting and the circumstances of the case.

In Sheppard v. Maxwell, the Supreme Court described a continuance or transfer as possible responses when prejudicial pretrial news creates a reasonable likelihood that a fair trial will be prevented. The opinion stated: “But where there is a reasonable likelihood that prejudicial news prior to trial will prevent a fair trial, the judge should continue the case until the threat abates, or transfer it to another county not so permeated with publicity.” That language comes from the Court’s 1966 opinion; whether it governs a present-day motion in a particular way depends on the jurisdiction and later applicable law.

A continuance gives time for attention to abate

A continuance postpones proceedings rather than changing the community from which jurors are drawn. Its practical logic is that intense coverage may fade with time. Whether that is likely, how long a delay would need to be, and what costs postponement would create are case-specific questions for counsel and the court. A delay may not solve the problem if the relevant publicity remains influential or continues during the postponement.

What can jury selection and trial protections accomplish?

Voir dire can test exposure and fixed opinions

Defense counsel may ask the court to question prospective jurors about whether they encountered coverage, formed opinions, and can decide the case solely on evidence admitted in court. Depending on the case and court rules, individual questioning may help assess a prospective juror’s response without relying on a group answer. Voir dire is a protective measure, not a guaranteed cure: questions can help the court evaluate impartiality, but do not make publicity disappear.

Instructions and sequestration address exposure during trial

The court may instruct jurors to avoid media coverage and decide the case on evidence admitted in court. Sequestration can limit jurors’ opportunity to encounter outside coverage while the trial is underway. Both measures are directed at jurors rather than independent publishers, but their reach and practical burdens differ. The court must decide whether either measure is appropriate in light of the identified risk and the record.

Courtroom management can reduce disruption

Courts can manage courtroom conduct and access to trial materials to reduce disruption or outside influence. The relevant question is whether the particular courtroom condition or conduct is contributing to the threat and whether a measure within the court’s authority could address it. This is distinct from an order controlling what an independent news organization may publish.

Can a defendant ask a judge to stop the press from reporting?

A defendant may raise the danger that publicity threatens a fair trial, but should not assume the judge can prohibit the press from reporting. An order that prevents publication in advance is a prior restraint and raises substantial First Amendment concerns. Courts have more practical authority over jurors, courtroom conditions, lawyers participating in a case, and officials within their authority than over independent reporting.

In Nebraska Press Association v. Stuart, a state judge restricted publication of confessions, admissions, and other strongly implicative facts in a widely covered murder case. The Supreme Court reversed the order. The record did not establish that less restrictive measures would fail, and parts of the order were too broad and vague. The decision illustrates why a court is expected to consider available protections short of a prior restraint; it does not make every possible restriction on every participant identical to an order directed at the press.

Sheppard also discusses controls on extrajudicial statements by lawyers, parties, witnesses, and court officials, as well as regulations for government employees. Those measures concern people or conduct subject to the court’s authority. They are constitutionally and practically different from broadly silencing independent news outlets. The scope of any order depends on applicable constitutional rules and the court’s authority.

How should the court assess the risk and requested relief?

A useful way to organize a request is to connect the evidence to a specific risk and then explain why the proposed remedy fits it. The following questions help clarify that connection; they do not replace the legal standard in the court where the case is pending.

  • What exposure is at issue? Distinguish pretrial exposure affecting a local jury pool from coverage that jurors might encounter during trial, or publicity generated by participants in the case.
  • What is the practical reach? Consider the actual content and reach of the coverage, including its geographic spread and any known online reach. A transfer may have different practical value depending on where the coverage has circulated.
  • When could the protection work? A continuance may give attention time to abate, while voir dire tests prospective jurors and sequestration or instructions focus on trial-period exposure. Consider the effect of delay in the particular case.
  • Whose conduct would the order affect? A measure directed at jurors or participants differs from a prior restraint on independent reporting. Identify which people and activities the court can regulate.
  • What supports the request? Use the record and the governing local procedure to show why the risk is real and why the requested measure could address it. The court still determines the applicable test and whether it can grant the relief.

In Sheppard, the Court emphasized prevention rather than relying on reversal after a trial: “But we must remember that reversals are but palliatives; the cure lies in those remedial measures that will prevent the prejudice at its inception.” The practical implication is to raise a concrete concern early enough for the trial court to consider protections, not to assume that a later appeal can undo every effect of publicity.

What if the case is a court-martial?

Military proceedings require military authorities and rules; the framework for a court-martial should not be treated as a universal test for civilian jury trials. In United States v. Simpson, the Court of Appeals for the Armed Forces discussed both presumed and actual prejudice. In that military context, presumed prejudice concerns inflammatory prejudicial publicity that saturates the community; actual prejudice concerns panel members who hold fixed opinions that prevent impartial judgment.

Simpson also discusses possible measures including continuance, venue change, sequestration, and regulation of public comments by counsel. Extensive reporting alone did not establish prejudice on that record. The case illustrates that publicity is evaluated in context, not by volume alone. Anyone dealing with a court-martial should use the rules and authorities governing that military proceeding rather than importing the military analysis into a civilian case.

What a defendant should take away

Media attention does not automatically invalidate a trial or entitle a defendant to a particular remedy. The useful course is to preserve concrete examples, work with counsel to identify the specific risk, and ask the court to consider a protection suited to that risk. The governing procedure and standard depend on the court and case. Because restrictions on independent press publication raise serious constitutional concerns, jury protections, continuances, venue requests, and measures directed at courtroom conduct or participants are distinct options to evaluate—not interchangeable guarantees of a fair trial.
