Dawn Richard alleged in a 2024 lawsuit that Sean “Diddy” Combs demeaned her and her Danity Kane bandmates and deprived them of adequate food and sleep during work on his productions. She later testified that she witnessed Combs attack Cassie Ventura. Aubrey O’Day has discussed a separate allegation in an affidavit shown in a documentary, but said she could not remember the incident or confirm that it involved her. These are distinct accounts—not a shared statement by every Danity Kane member.
What did Dawn Richard say about Diddy?
In a complaint filed September 10, 2024, Richard described her years working with Combs, first through Making the Band and Danity Kane, and later with Diddy – Dirty Money. She alleged that Combs used demeaning language toward her and her bandmates, criticized their appearances, and failed to provide adequate food and sleep during production, recording, and rehearsal.
Richard’s complaint alleged that some recording and rehearsal stretches lasted 36 to 48 hours without breaks. That figure is her allegation in a civil pleading, not an independently verified finding. The complaint also situates the claims in the period when she worked with Combs; it is not a finding that the events occurred.
What did Dawn Richard testify she saw?
At Combs’s federal trial in May 2025, Richard testified that she witnessed him attack Cassie Ventura and that he threatened her after she saw violence. The Associated Press reported that Richard understood the phrase “we could go missing” to mean “That we could die.” Those words are Richard’s reported testimony, not a court finding about the alleged threat.

The defense challenged Richard’s motive, suggesting she was angry about the end of Danity Kane and Diddy – Dirty Money and was influenced by her pending lawsuit. Her testimony should therefore be understood as sworn testimony that was contested at trial, not as an adjudicated conclusion in Richard’s civil case.
What did Aubrey O’Day say about the affidavit?
O’Day’s account is separate from Richard’s. In a CBS News interview published December 23, 2025, she discussed a witness affidavit shown in a Netflix documentary. The affidavit alleged an assault involving O’Day, Combs, and another man. O’Day said she had no memory of the incident and did not know whether she was the person described. Discussing her reaction to the affidavit and documentary, she said, “I don’t even know if I was raped. And I don’t want to know.”

That is not an allegation O’Day said she could independently recall. CBS also reported that a representative for Combs categorically denied the allegations referenced in the documentary.
Was Dawn Richard’s lawsuit dismissed?
Yes. On June 12, 2026, U.S. District Judge Katherine Polk Failla dismissed Richard’s second amended complaint. The order dismissed Count One without prejudice and Counts Two through Eighteen with prejudice. The Associated Press reported that most claims were dismissed as untimely and that Richard’s lawyer planned to refile her primary claim in state court.

The order addressed whether the claims could proceed under the applicable legal rules; it did not decide whether the alleged events happened. The judge wrote that the allegations were “which, if true, are execrable,” while making clear that the court’s resolution was independent of its disapproval of them. The phrase is not a finding that the allegations are true.
