Stacey Stillman alleged that Survivor producer Mark Burnett influenced two contestants to vote her out of Survivor: Borneo. CBS and the producers denied it, and the contemporary court reports do not establish that the elimination was fixed. The claim was covered publicly, and deposition testimony was released; the available record does not support saying CBS kept the lawsuit quiet.
What did Stacey Stillman allege?
Stillman was voted out of the Tagi tribe during the first season of Survivor. On February 6, 2001, CBS/AP reported that she had filed a 14-page lawsuit against CBS, Burnett and others. She alleged that Burnett persuaded Dirk Been and Sean Kenniff to vote against her rather than Rudy Boesch, then 72, in order to keep the season’s oldest remaining contestant in the game and appeal to an older audience. CBS called the allegations groundless and denied them. CBS News/AP’s report on the filing describes the claims and CBS’s response.

The reported causes of action included fraud, breach of contract and unlawful business practices. Stillman sought restitution for lost prize money and $75,000 in punitive damages; that was an amount she requested, not money awarded by a court.
Was Survivor: Borneo rigged?
The reports establish that Stillman made the allegation, not that the show fixed the vote. The key accounts of Been’s testimony emphasize different parts of what he said, and the other central participants disputed that votes were improperly controlled.

Been also testified, according to the CBS News/AP account, that Stillman lost the vote 5–2. He said the other four votes against her would have eliminated her even if his vote had gone the other way. That arithmetic bears on whether his vote alone changed the outcome; it does not settle whether a producer attempted to influence contestants.
What did the courts decide?
The reported rulings concern litigation procedure and confidentiality, not a final determination that the elimination was or was not fixed.

May 2001: claims allowed to proceed at that stage
On May 18, CBS News reported that a court let production company SEG’s breach-of-contract and defamation claims against Stillman proceed after she sought to quash them under California’s anti-SLAPP law. This was an interim procedural report, not a ruling on the truth of her allegation. CBS News, May 18, 2001.
June 2001: a tentative view on contract and defamation claims
A June 26 Associated Press report on a tentative ruling said the judge indicated Stillman could not be sued for breach of contract on the basis of her claims, while SEG’s defamation claim could proceed. A tentative ruling is not a final merits judgment. The report also noted that Burnett and CBS denied influencing votes. CBS News/AP, June 26, 2001.

The deposition was not kept sealed
In May, CBS News said it appeared Been’s deposition might not be sealed; its May 25 report said the testimony had been publicly released. The Los Angeles Times separately reported that the judge rejected an effort to seal it. In a report about the judge’s preliminary view of confidentiality, the paper quoted Judge Ralph Dau: “Manipulation of votes, if it in fact existed, is not a trade secret.” The phrase “if it in fact existed” is essential: this was a conditional comment about confidentiality, not a finding that manipulation occurred. Did CBS keep the Survivor lawsuit quiet?
The contemporary record points the other way. CBS News/AP, ABC/Reuters and the Los Angeles Times all reported on the suit, its claims or the related testimony and court proceedings. The deposition became public. That does not tell us how widely every detail circulated, but it does not support describing the lawsuit as kept quiet.

What is known about the case’s final outcome?
The material available here does not establish a final verdict on whether Burnett influenced the elimination, or document a settlement or dismissal of the original action through a primary court record. A later LegalClarity explainer mentions a 2003 appellate proceeding, but that reference alone does not establish how the original lawsuit ultimately ended. LegalClarity’s secondary explainer should not be treated as proof of a final outcome.
