Tyrese and Samantha Lee Gibson’s divorce became contentious because their premarital agreement did not settle child custody or child support. Those issues went to court, alongside disputes over retroactive support, legal fees and compliance with support orders. Georgia courts later upheld the challenged financial rulings; a separate custody-warrant request reported in 2026 remains unresolved in the available account.
Why did the divorce become so contentious?
The agreement covered much of the couple’s financial relationship, but it expressly left child support outside its terms. Custody was also for the court to decide. That meant the agreement could not settle some of the most consequential questions concerning their daughter, and litigation continued over support, legal expenses and later compliance with court orders.
Samantha Lee Gibson petitioned for divorce on September 21, 2020. According to the Georgia Court of Appeals, some issues had been resolved before a bench trial focused principally on child support, spousal support, attorney fees and litigation expenses. The final trial took place August 29–30, 2022. A decree entered February 14, 2023, was made effective nunc pro tunc to August 30, 2022—a legal designation that gives it an earlier effective date.
What did their premarital agreement cover—and leave open?
The Georgia Court of Appeals said the agreement addressed premarital and postmarital property and acquisitions, allocation of debts, division of income, and limits on spousal support. It also included provisions for arbitration and attorney fees.

But the agreement specifically excluded child support from its reach. The appellate opinion quotes it as saying: “Nothing herein shall affect the determination of child support for any child born or adopted between the parties.” In other words, the contract did not set the amount of child support, and it did not resolve custody. Those questions remained for the court.
What did the court order?
The following amounts come from the Georgia Court of Appeals’ 2024 account of the trial-court rulings and from the separate Fulton County contempt order. They concern different obligations and proceedings.

The Court of Appeals’ opinion also recited financial-affidavit figures used in the trial-court proceedings: gross monthly income of $275,132 and adjusted monthly income of approximately $264,310. These are case-record figures, not a current estimate of Tyrese’s income.
What did the appeal decide?
On November 25, 2024, the Georgia Court of Appeals affirmed the challenged rulings, including the high-income child-support deviation, retroactive support and attorney-fee award. The appellate opinion also addressed arbitration over the meaning of the agreement’s attorney-fee provision: the trial court had confirmed the arbitration award, and the appeals court found no basis to reverse that ruling.

Was the 2024 detention the same as the 2023 contempt order?
No. The October 2023 Fulton County order concerned $29,156.07 in arrears and interest, with that amount set to purge contempt. The Los Angeles Times separately reported that Tyrese was taken into custody in September 2024 after another contempt ruling and a directive to pay more than $73,500. The newspaper initially described the episode as an arrest; Tyrese told the Times, “I was detained, not arrested,” and said he was held for less than two hours. The Times reported that an appeal filing preceded his release. His description is a party’s public characterization, not the wording of a court finding.

On September 29, 2026, TMZ reported that Tyrese had sought an arrest warrant against Samantha over alleged violations of a custody plan connected to an alleged September 2025 incident. TMZ also reported that Samantha opposed the request, said she had primary custody and disputed his account. These are competing claims reported by the outlet, not findings that a court has adjudicated. The available account does not establish whether the warrant request was granted or what its current status is.
