BitTorrent is only a file-distribution technology, but using it to obtain or share a copyrighted book without permission can infringe the copyright holder’s rights. In the United States, statutory damages can reach $30,000 per infringed work—or $150,000 for willful infringement—along with possible legal fees.
That does not make every torrent illegal. Public-domain books, openly licensed works, and files distributed by their rights holders can be shared lawfully. For most readers, however, direct legal services are safer, easier, and better maintained. Here are the strongest options for borrowing, reading, and downloading ebooks and audiobooks without relying on unverified torrent sources.
BitTorrent is not the legal test
A torrent does not automatically identify a file as legal or illegal. The important question is whether the person or organization distributing the particular ebook or audiobook has permission to do so.
A file may be legitimately shared when it is:
- In the public domain in the relevant country.
- Released under a license that permits copying and redistribution.
- Distributed by the copyright owner, publisher, author, or an authorized institution.
- An open-access work whose license allows downloading and sharing.
A website calling a download “free” has not necessarily established any of those facts. “Free” can mean that no money is charged; it does not automatically mean that copying is authorized. Project Gutenberg makes this distinction explicitly, and its copyright guidance is particularly important for readers outside the United States.

The best legal sources for ebooks and audiobooks
| Service | Best for | What you get | Main limitation |
|---|---|---|---|
| Libby | Current books through public libraries | Borrowed ebooks and audiobooks | Requires a participating library card; popular titles may have holds |
| Open Library | Controlled digital lending and browser reading | Borrowable ebooks and some audio links | Availability depends on the title and lending model |
| Project Gutenberg | Older public-domain literature | Free ebook downloads and selected audiobooks | Mostly older works; copyright status is jurisdiction-specific |
| Standard Ebooks | Well-formatted public-domain classics | Polished EPUB and other ebook formats | Focused on public-domain literature, not current releases |
| LibriVox | Volunteer-read classics | Free public-domain audiobooks | Narration quality and completeness vary |
1. Libby: the practical choice for current releases
Libby is usually the best starting point for current ebooks and audiobooks. It connects to participating public libraries, so the selection, borrowing limits, and waiting lists depend on your library system.
In the Libby app, use this path:
- Open Search in the footer.
- Search for an author, title, or subject.
- Open the book’s listing.
- Select Borrow when a copy is available.
- On the confirmation screen, check the loan period beside “Borrowing for…”, if your library offers a choice.
- Select Borrow again.
- Open Shelf in the footer, then choose Loans.
For an ebook, choose Read With… and select Libby or, where supported by the library, Kindle. For an audiobook, select Open Audiobook. If every copy is in use, Libby shows Place Hold. Some libraries instead show Notify Me when a title is not currently in their collection.
To find something you can start immediately, open search results or a collection, open the filters dialog, choose Availability > available now, and select Show Titles.
Libby automatically returns loans on their due dates. Its mobile apps also download book and audiobook loans over Wi-Fi by default. That setting matters for audiobooks, since many are larger than 300 MB. In the mobile app, download controls are under Menu > Downloads; those controls are not available when using Libby in a web browser.
2. Open Library: borrow and read in a browser
Open Library is useful when you want to search a large catalog and read a digitized book in the browser. Search for a title and select Show only eBooks to narrow the results.
On a listing, a Read button indicates that the book can be opened online. A Borrow button indicates that it is available to registered users. Selecting Read in Browser opens Open Library’s BookReader.
Open Library generally lends borrowable books to one patron at a time. Full loans commonly last 14 days, while some browsing loans last one hour. A user can borrow up to 10 books at once. Some records also show a listen option. Where a volunteer recording exists, a LibriVox link may appear in the record’s identification details.
3. Project Gutenberg: public-domain ebooks and some audio
Project Gutenberg remains one of the simplest sources for older literature. Its collection focuses primarily on works whose U.S. copyrights have expired, and books can normally be read online or downloaded in several formats.
Its audiobook offerings include human-read recordings, links to LibriVox, an Open Audiobook Collection of computer-generated readings, and older computer-generated recordings. The listening experience is less uniform than a commercial audiobook service, but the material is free to access.

- Our fastest Kindle Paperwhite ever – The next-generation 7“ Paperwhite display has a higher contrast ratio and 25% faster page turns.
- Ready for travel – The ultra-thin design has a larger glare-free screen so pages stay sharp no matter where you are.
- Escape into your books – Your Kindle doesn’t have social media, notifications, or other distracting apps.
- Battery life for your longest novel – A single charge via USB-C lasts up to 12 weeks.
- Read in any light – Adjust the display from white to amber to read in bright sunlight or in the dark.
Do not treat a Project Gutenberg listing as a worldwide copyright clearance. The project’s collection decisions are primarily based on U.S. law. A book that is public domain in the United States may still be protected in another country, particularly where copyright terms, translations, or publication rules differ.
4. Standard Ebooks: better editions of classic works
Standard Ebooks is a strong choice when format and presentation matter. Its volunteers produce carefully edited, modern ebooks with attention to typography, accessibility, metadata, and navigation.
The project generally works with books published before January 1, 1931, although that date is a practical collection guideline rather than a universal copyright rule. Standard Ebooks says its own production work and released ebook files are dedicated to the public domain through CC0. Check the project’s statements and your local law before redistributing a title.

5. LibriVox: free volunteer-recorded audiobooks
LibriVox records books it considers to be in the U.S. public domain and places its recordings in the public domain. Its catalog supports listening and downloading, making it a useful companion to Project Gutenberg and Open Library.
The trade-off is consistency. Recordings are made by volunteers, so audio quality, accents, pacing, and microphone quality differ. Some titles have several versions or languages, while others may contain incomplete chapter contributions. Check the catalog entry before starting a long book.
When a torrent can be legitimate
Authorized torrents are possible, but they should be treated like any other download: verify the rights before opening the file. A sensible checking process is:
- Identify the rights holder or institution hosting the work.
- Read the title’s copyright, license, or public-domain statement.
- Confirm that the permission covers redistribution, not merely personal reading.
- Use the institution’s own download page rather than an unexplained mirror.
- Be especially cautious when a torrent contains a current commercial release or an entire publisher catalog without an explicit authorization statement.
For ordinary readers, a torrent is rarely necessary. Project Gutenberg, Standard Ebooks, and LibriVox already provide direct downloads for the material they lawfully distribute. Direct downloads also make it easier to identify the source, format, license, and file contents.

Common claims that do not hold up
“If it costs nothing, it is legal.”
No. A free price and legal permission are different things. Confirm the license or copyright status.
“A VPN makes copyrighted torrenting legal.”
No. A VPN may change how your traffic is routed or affect privacy, but it does not grant permission to copy or distribute a book.

“Downloading is legal if I do not upload.”
That is not a reliable assumption. Peer-to-peer clients commonly exchange pieces of a file with other participants. Unauthorized downloading and uploading can both create infringement issues.
“Personal use automatically counts as fair use.”
Fair use is fact-specific. It is not a blanket authorization to download or share a complete commercial ebook or audiobook.

“A takedown notice proves the file was legal before removal.”
A takedown process requests removal; it does not establish that the earlier distribution was authorized.
A safer decision guide
- Want a current bestseller? Check Libby first, then your library’s other digital services or a licensed retailer.
- Want a classic novel? Search Standard Ebooks or Project Gutenberg for an ebook.
- Want the audio version of a classic? Search LibriVox and check whether multiple narrations are available.
- Need browser reading or a digitized scan? Try Open Library.
- Found a torrent claiming to be free? Look for a clear rights statement from the author, publisher, or hosting institution. If there is none—especially for a recent release—do not assume it is authorized.
FAQ
Are torrent sites for ebooks and audiobooks legal?
The technology itself is not automatically illegal, but sharing or downloading a copyrighted work without authorization may infringe copyright. A torrent is lawful only when the particular files are authorized, openly licensed, or public domain in the relevant jurisdiction.
What is the best legal alternative for current ebooks and audiobooks?
Libby is usually the best first option if you have a card from a participating public library. You can borrow ebooks and audiobooks, place holds, and return loans automatically on their due dates.
Where can I download free public-domain audiobooks?
LibriVox offers volunteer-recorded audiobooks of works it considers public domain in the United States. Project Gutenberg also links to several audiobook collections.
Is a book public domain everywhere if it is public domain in the United States?
No. Copyright terms differ by country and can depend on publication history, author death date, translations, renewals, and other factors. Check the law that applies where you live before redistributing a work.
The Bottom Line
Skip unverified torrent indexes, particularly those offering current commercial books without a clear authorization statement. Use Libby for current library loans, Open Library for controlled digital lending, Project Gutenberg and Standard Ebooks for public-domain ebooks, and LibriVox for volunteer-read public-domain audio. These services provide a clearer source and a substantially safer route than downloading an unexplained torrent.
