What Sunny Hostin said about the lawsuit
In January 2025, Hostin called American Transit’s lawsuit frivolous. She said the insurer was trying “to avoid paying for medical and surgical procedures for people it insured who were in pain,” and accused it of using her celebrity status to generate a media smear campaign. Those were Hostin’s allegations about the insurer’s motives.
What American Transit accused her husband of
American Transit filed a civil lawsuit in December 2024 in the U.S. District Court for the Eastern District of New York. The insurer accused Emmanuel Hostin and Hostin Orthopaedics & Sports Medicine, along with other medical providers, of participating in an alleged scheme involving fraudulent no-fault medical billing and kickbacks tied to surgeries and ambulatory surgical centers. These were claims in the insurer’s lawsuit, not findings that the defendants committed fraud.
As reported by InsuranceNewsNet in January 2025, the complaint sought more than $153 million in compensatory damages and more than $459 million in treble damages. The report said the complaint described an alleged treatment protocol involving 5,800 patients; those figures do not mean damages were awarded or that the patients were found to have participated in wrongdoing.

Coverage at different points described the case as involving 180, 186, or about 200 defendants. Because those totals vary by reporting snapshot, there is no single count to state here without qualification. InsuranceNewsNet reported on January 28, 2025, that 141 of 186 defendants had settled at that point, while noting it did not know whether Hostin was among them.

Hostin’s side denied the allegations
Daniel Thwaites, attorney for Emmanuel Hostin, said his client “denies each and every allegation.” He characterized the case as a “blanket, scattershot, meritless lawsuit by a near-bankrupt insurance carrier” and argued that it was intended to deter doctors from collecting payment for care provided to the insurer’s customers.

The insurer defended its decision to sue
American Transit attorney William Natbony said the company had “commenced its lawsuit as part of its statutory responsibility to fight no-fault fraud which is rampant in New York.” Natbony also denied allegations of improper conduct by the insurer or its counsel.
The dispute concerned New York’s no-fault insurance system, which covers certain medical and other economic losses after motor-vehicle injuries. The descriptions of treatment pathways and alleged billing practices above reflect the insurer’s claims as reported, not an independent determination about the providers or patients.

InsuranceNewsNet reported on July 9, 2025, that Hostin and Hostin Orthopaedics & Sports Medicine had settled with American Transit and that the insurer filed a stipulation of voluntary dismissal as to them. The report said the insurer had settled with 161 of 180 initial defendants overall. That count comes from a later report using a different stated initial total than the January snapshot.
A July 10, 2025, report said American Transit withdrew its lawsuit against Hostin and quoted the company as saying it “deeply regrets any public speculation against Dr. Emmanuel Hostin, his wife, Sunny Hostin, or his children.” The reports do not disclose the settlement terms, whether it included an admission, or whether any money was paid. A settlement and voluntary dismissal are not a merits ruling or a court exoneration.
