The Menendez brothers won a procedural ruling on April 11, 2025: a judge rejected the Los Angeles district attorney’s request to withdraw an earlier resentencing motion, allowing the case to proceed. The ruling did not resentence Lyle and Erik Menendez or order their release. They were later resentenced to 50 years to life in May 2025, a separate step that made them eligible for parole consideration.
What happened at the April 11, 2025 hearing?
Los Angeles County Superior Court Judge Michael Jesic denied District Attorney Nathan J. Hochman’s request to withdraw a resentencing motion filed by the prior district attorney. The court scheduled the resentencing matter for April 17 and 18 at the Van Nuys Courthouse. The decision kept that route open; it was not a ruling on whether the brothers should be released. Source

Hochman said his office was prepared to proceed on a resentencing motion initiated by the court while seeking to withdraw the previous administration’s motion. Why was it a procedural win, not a release decision?
The hearing addressed whether the earlier resentencing motion would remain available, not whether the brothers would leave prison. Resentencing, a request for a new trial, and parole are separate legal routes, with different outcomes and decision-makers.

What happened after the hearing?
May 2025: a new sentence
The brothers were resentenced to 50 years to life in May 2025. The sentence made them eligible for parole consideration under the youthful-offender framework; eligibility did not itself mean they would be released. Source
September 2025: the separate new-trial request
Their habeas petition, which sought a new trial rather than a different sentence, was denied in September 2025, according to the district attorney’s statement. That outcome did not undo the resentencing ruling. Source

Spring 2027: a reported, tentative parole opportunity
The Associated Press reported on September 8, 2026, that the brothers could face the parole board again in spring 2027 after earlier denials in 2025. The timing was described as tentative, so it should not be treated as a confirmed hearing date. Associated Press report

In an October 24, 2024 release, Los Angeles County said its Resentencing Unit and Murder Resentencing Unit had reviewed or were reviewing 705 cases and had obtained 332 resentencings.
