Oyer said she was fired the day after refusing to recommend Mel Gibson for restoration of his federal firearm rights. The timing prompted questions about whether the dispute caused her removal, but the connection has not been established: a DOJ official denied it at the time, and former Deputy Attorney General Todd Blanche later said he did not know about Gibson or the letter when he fired Oyer.
What Oyer said happened
In a March 11, 2025 account, ABC News reported that Oyer said Gibson’s lawyers sought to have him added at the last minute to a Justice Department memo listing potential candidates for firearm-rights restoration. According to Oyer, the request followed contact between Gibson’s lawyers and senior DOJ officials and cited Gibson’s recent special appointment from President Donald Trump.
Oyer said an official in Blanche’s office pressed her to reconsider and invoked Gibson’s personal relationship with Trump. She said she declined to recommend him and was fired the following day. Her termination letter, which she posted on LinkedIn, did not give a reason, ABC reported.
Oyer described her concern in public-safety terms: “Giving guns back to domestic abusers is a serious matter that, in my view, is not something that I could recommend lightly because there are real consequences that flow from people who have a history of domestic violence being in possession of firearms.”

Why Oyer said she objected
Oyer’s stated concern was not simply that Gibson had sought restoration. ABC reported that his federal firearm prohibition followed his 2011 no-contest plea to a misdemeanor charge of battering his former girlfriend. A plea and a later restoration request are distinct from a presidential pardon, and the reporting does not say Gibson received a restoration decision.
In a March 26, 2025 letter, Democratic members of the Senate Judiciary Committee summarized Oyer’s account as saying Gibson had not undergone the thorough investigation used for other candidates. The letter was an inquiry by committee members, not an independent investigation’s finding or a court ruling.
What DOJ and Blanche said about the firing
The accounts leave the alleged connection contested. ABC reported that a DOJ official disputed that the disagreement over Gibson played a role in Oyer’s removal. The termination letter Oyer posted did not explain the decision.
In September 2026, the Associated Press reported that Oyer had sued, seeking a declaration that her termination was unlawful and reinstatement to federal service. Her complaint alleges violations of civil-service protections and her First Amendment rights. AP also reported Blanche’s later statement, at his attorney-general confirmation hearing, that he did not know about Gibson or the letter when he fired Oyer. He cited other reasons, including Oyer’s earlier clemency recommendations. These are competing accounts; the cited reporting does not establish that a court has resolved them.

How federal firearm-rights restoration fits in
DOJ describes the Office of the Pardon Attorney as supporting the President’s exercise of executive clemency. The department lists restoration of federal firearm rights under 18 U.S.C. § 925(c) as a separate program area, rather than treating it as a presidential pardon.
In a July 18, 2025 announcement of a proposed rule, DOJ said federal law empowers the Attorney General to grant relief under § 925(c) when a person is not likely to act in a manner dangerous to public safety. The proposed approach would leave discretion with the Attorney General and assess cases individually. At that stage, DOJ told potential applicants to comment on the proposed process rather than submit applications.
