Los Angeles County prosecutors announced on January 24, 2025, that they would not file criminal charges against Brian Warner, known as Marilyn Manson. The district attorney’s office said the domestic violence allegations were outside the statute of limitations and that it could not prove sexual assault charges beyond a reasonable doubt. That was a decision not to prosecute—not a criminal trial or a verdict deciding whether the allegations were true.
Why prosecutors declined to file charges
Los Angeles County District Attorney Nathan Hochman announced the decision after an investigation described as lasting four years. The office gave different legal reasons for the two categories of allegations: it said the domestic violence allegations fell outside the applicable statute of limitations, while it could not prove sexual assault charges beyond a reasonable doubt. The Associated Press reported the announcement and the DA’s stated rationale.
The distinction matters. A statute of limitations restricts how long prosecutors have to bring a charge. The beyond-a-reasonable-doubt standard concerns whether prosecutors believe the evidence can establish guilt to the demanding standard required for a criminal conviction. The DA’s office stated: “We have determined that allegations of domestic violence fall outside of the statute of limitations, and we cannot prove charges of sexual assault beyond a reasonable doubt.” Neither explanation is a finding by a judge or jury about what happened.
What happened during the investigation
The Los Angeles County Sheriff’s Department investigation concerned allegations involving incidents between 2009 and 2011 in West Hollywood. The Associated Press reported that investigators served a search warrant at Warner’s home and initially sent the case to prosecutors in September 2021; prosecutors requested further evidence-gathering.

On October 9, 2024, then-District Attorney George Gascón said prosecutors were reviewing new leads and additional evidence from the sheriff’s investigation. He said the office wanted a complete picture of the admissible evidence before deciding whether to file charges. The County of Los Angeles published Gascón’s statement.
Hochman announced the no-charge decision on January 24, 2025. The result was that the county would not bring a criminal case on these allegations; there was no criminal trial in which the evidence was tested before a jury.

What the decision does—and does not—say about the allegations
Several women made public allegations against Warner, including actress Esmé Bianco and Evan Rachel Wood. Warner denied abuse allegations. Those are attributed claims and denials, not findings established by the DA’s charging announcement.
Warner’s attorney, Howard King, told the Associated Press: “We are very pleased that, after a thorough and incredibly lengthy review of all of the actual evidence, the District Attorney has concluded what we knew and expressed from the start — Brian Warner is innocent.” That is King’s characterization of the decision, not a court’s verdict.

Bianco said she was disappointed by the decision and “sadly not surprised.” Her reaction reflects her own view; it should not be treated as a statement on behalf of every accuser. Neither a lawyer’s response nor an accuser’s reaction changes the legal meaning of the DA’s decision.

A criminal prosecution and a civil lawsuit are separate legal proceedings. The DA’s announcement resolved whether Los Angeles County prosecutors would bring criminal charges; it did not decide a civil claim. Likewise, a civil settlement or a procedural development in a civil case does not establish criminal guilt or overturn the DA’s charging decision.

In a January 29, 2026, release, attorneys for Ashley Walters said a Los Angeles Superior Court judge revived her civil lawsuit on January 26, after it had been dismissed in December 2025, following passage of AB 250. That account is from Walters’s counsel, not a court docket. It is a reported civil-case development and does not alter the January 2025 criminal decision.
