The District Attorney’s Office said the domestic violence allegations fell outside the statute of limitations and that it could not prove sexual assault charges beyond a reasonable doubt. That prosecutorial decision was not a court ruling on whether the allegations were true or false.
Why prosecutors declined to file charges
District Attorney Nathan Hochman said the office determined that “allegations of domestic violence fall outside of the statute of limitations” and that prosecutors “cannot prove charges of sexual assault beyond a reasonable doubt.” Those were the office’s stated legal grounds for not filing charges, not findings made by a judge or jury. The two grounds are distinct. A statute of limitations sets a deadline for bringing a criminal case; the DA’s office said the domestic violence allegations were outside that period. Separately, prosecutors said they could not meet the criminal standard of proof for sexual assault charges: proof beyond a reasonable doubt.
How the case reached the decision

What the decision does—and does not—mean
“No criminal charges” describes the prosecutor’s decision not to bring a criminal case. It does not, by itself, establish that allegations were false or that Warner was exonerated; nor is it a court determination of the underlying allegations. The stated inability to prove sexual assault charges beyond a reasonable doubt is a charging assessment by the DA’s office.

The criminal charging decision is separate from civil litigation. The Associated Press reported that actor Esmé Bianco, who said she was among those involved in the criminal investigation, expressed disappointment with the decision and that her separate lawsuit had settled. A civil settlement is not the same outcome as a criminal prosecution, and it should not be treated as part of the DA’s charging decision. Associated Press, January 24, 2025
