Live Nation’s Monopoly Trial and Reported Tensions Inside Trump’s Justice Department

Semafor reported that Live Nation settlement talks exposed tensions inside DOJ. The federal proposed judgment and the states’ jury verdict are separate proceedings, and the later remedy status remains unresolved in the records cited here.

Semafor reported in February 2026 that Live Nation executives and lobbyists were negotiating with senior Justice Department officials outside the Antitrust Division, with some discussions sidelining division chief Gail Slater. The reported disagreement was an internal DOJ dispute—not an official finding that the company had violated antitrust law, and not a court ruling. The case later split into two tracks: DOJ negotiated a proposed settlement, while states that did not join it continued to trial and won a jury verdict on antitrust claims.

What Semafor reported about the DOJ dispute

According to Semafor, citing people familiar with the matter, Live Nation executives and lobbyists held settlement talks with senior DOJ officials outside the Antitrust Division. Some discussions reportedly sidelined Gail Slater, then chief of the division. That account describes reported internal tensions over how to handle the case; it does not establish that the department formally found misconduct by Live Nation or that Slater was removed from her role.

The distinction matters: a disagreement within the government about settlement strategy is not the same as a disagreement over a court’s findings. The lawsuit’s allegations, the federal settlement process and the states’ trial each have separate legal status.

What happened to the lawsuit

On May 23, 2024, the Justice Department and 30 state and district attorneys general filed a civil antitrust lawsuit against Live Nation Entertainment and its wholly owned subsidiary Ticketmaster LLC. DOJ alleged monopolization and exclusionary conduct across live-entertainment markets. Those were the government’s claims at filing, not adjudicated facts.

DOJ’s original theory described a so-called “flywheel”: it alleged that ticketing and sponsorship revenues could support exclusive artist-promotion deals, while access to artists could help the company secure long-term ticketing arrangements with venues. Assistant Attorney General Jonathan Kanter characterized DOJ’s position at filing this way: “The live music industry in America is broken because Live Nation-Ticketmaster has an illegal monopoly.” That was the department’s allegation and advocacy, not a neutral court determination.

Two legal tracks, with different status

States’ continued litigation States that did not join the federal settlement and continued litigating On April 15, 2026, a jury found for the states on antitrust claims against Live Nation and Ticketmaster, according to the New York Attorney General’s office. The jury verdict is distinct from DOJ’s proposed judgment. It does not, by itself, establish the final remedy or the outcome of later post-trial proceedings.

The tracks should not be collapsed into a single “settlement” or “trial outcome.” DOJ pursued a negotiated federal resolution, while the states outside that resolution pursued their own case and obtained a jury verdict. Any proposed conduct remedies or structural remedies must be described according to the specific track and its procedural status; the materials available here do not establish a final remedy in either track.

What is known about Trump’s contact with Live Nation

The Associated Press reported that Live Nation’s lawyers disclosed in a court filing that President Donald Trump and CEO Michael Rapino spoke in February 2026 about the antitrust lawsuit. The lawyers said they did not discuss substantive settlement terms. AP also reported that White House lawyers were involved in communications between the company and DOJ in February and March.

Those disclosures establish reported contact and communications, not that Trump directed, caused or negotiated the settlement. The company’s lawyers’ statement about the conversation’s subject should be kept distinct from the reported DOJ negotiations.

What remains unresolved

Live Nation’s July 30, 2026 SEC filing said its post-trial motions were scheduled for argument on July 31. That filing reported a scheduled hearing; it does not establish what the court decided afterward. As of October 8, 2026, the materials cited here do not resolve the post-hearing status, final remedy or any appeal outcome. A current account of those matters requires a later court-docket update.

The same filing said Live Nation recorded an estimate of $450 million for the six months ended June 30, 2026, for its ultimate loss associated with settling states and the jury’s damages award. That is the company’s estimate, not a court-ordered final amount.
